$10 million Scratcher Lottery Ticket sold in Cameron Park - Winner a Mystery

A California Lottery player decided to go for the gold on the new $30 California Gold Scratchers and won $10 million!

The odds of winning the $10 million jackpot are about 1 in every 3,009,060.

Kulbir Grewal purchased the winning ticket at Vineyard Market, which is located at 2643 Cameron Park Drive in Cameron Park.

The big winner has declined media requests for interviews.  There are a few people in the Sacramento area with the name Kulbir Grewal but the identity of the winner in a mystery.

Vineyard Market is now listed as a Lucky Retailer on the California Lottery website, thanks to Grewal’s jackpot. 

In a recent Yelp review Kathy F.`wrote, "I am very impressed by the Family that runs this Business. They bend over backwards to help make the 'Little hole in the wall' over here.. the neatest place to get produce..and other things..."

The California Lottery press release states that 98 players won $1 million or more in FY 2015-16. Approximately $1.59 billion was given to schools during the same period, according to the lottery’s website.

The $30 California Gold Scratchers includes eight bonus spots with another 38 chances to win up to $10 million.

Former South Tahoe Fire Captain Sentenced to 10 Years for Child Porn

On Friday Mark McLeod Wygant was sentenced to 10 years in prison for the crime of transporting child pornography.   

Wygant has been in custody since his arrest on January 29, 2015.  Four cameras were seized from the defendant’s vehicle on January 29, 2015.

According to court documents, between 2011 and 2012 Wygant secretly filmed a child on multiple occasions with the use of a hidden cell phone and hidden "spy cameras" that he had purchased for that purpose. 

Wygant then transported those videos and photos from a location in Butte County to South Lake Tahoe, where he worked at the time as a Fire Department captain.  The charges do not relate to any conduct committed during the course of his interaction with the public during his captain duties.

On February 12, 2015, "A federal grand jury returned a six-count indictment today against Mark McLeod Wygant, 44, resident of Chico, charging him with Sexual Exploitation and Attempted Sexual Exploitation of Minors," United States Attorney Benjamin B. Wagner announced.

On Dec. 22, 2016 U.S. Attorney Phillip A. Talbert announced "Mark McLeod Wygant, 46, of Chico, pleaded guilty today to transportation of child pornography." 

The case was ajudicated by the United States District Court Eastern District of California, 9th Circuit. 

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute those who sexually exploit children, and to identify and rescue victims. Roseville Woman Sentenced for Fraud including El Dorado Hills Home

Senior U.S. District Judge Garland E. Burrell Jr. sentenced Alla Samchuk, 45, of Roseville, to nine and a half years in prison for a mortgage fraud scheme and obstruction of justice, U.S. Attorney Phillip A. Talbert announced.

A federal jury returned a verdict in August 2016 finding her guilty of six counts of bank fraud, six counts of making a false statement to a financial institution, one count of money laundering, and one count of aggravated identity theft.

According to the evidence presented at trial, from 2006 through 2008, Samchuk, a licensed real estate salesperson, orchestrated a mortgage fraud scheme involving three properties in the Sacramento area using straw buyers. Two of the houses were purchased so that Samchuk herself could occupy them. She lacked the ability to qualify for a loan, so she instead recruited straw buyers to apply for the loans in their names. Samchuk caused the submission of loan applications containing false representations of income, employment, assets, and a false indication that the straw buyers would occupy the homes as their primary residence.

A second objective of the scheme was to obtain HELOC (home equity line of credit) funds. According to evidence at trial, on two of the properties, Samchuk diverted or attempted to divert HELOC funds to her own benefit. Samchuk caused the HELOC loans to fund by submitting false statements and documents to the lender regarding the qualifications of the straw buyers.

The scheme involved two properties in Roseville and one in El Dorado Hills. In 2007, Samchuk filed an application for a HELOC on one of the properties without the straw buyer's knowledge or consent. To obtain the HELOC, she forged the signature of the straw buyer on a short form deed of trust that she caused to be notarized and recorded. The stated purpose of the HELOC was home improvement, but once the line of credit was funded, Samchuk quickly diverted all of the funds to her own use, spending the proceeds on a Lexus and the repayment of a substantial personal debt.

Samchuk received a higher sentence because the district court found that she obstructed justice when she threatened a witness not to report the crime to federal authorities. The court found that Samchuk's statements to the witness constituted a threat that Samchuk purposefully calculated to dissuade the witness from alerting law enforcement about the fraud.

This case was the product of an investigation by the Federal Bureau of Investigation and the Internal Revenue Service-Criminal Investigation. Assistant U.S. Attorneys Audrey B. Hemesath and Andre M. Espinosa prosecuted the case....

Supporters Show Up at McClintock Town Hall Meeting to Support Trump Agenda

Republican Rep. Tom McClintock hosted a Town Hall Meeting at Oak Ridge High School in El Dorado Hills that was expected to draw many anti-Trump protesters.  Although McClintock has not been specifically targeted, Democratic activist are organized nationwide to protest every Republican Town Hall meeting.  Last month's McClintock Town Hall meeting in Roseville had so many unruly protesters that the County Sheriff asked to escort McClintock out of the riotous situation.  

This week's meeting in El Dorado Hill drew the expected out-of-area organized protesters, but among over 1,500 people that crowded the event included a large grass-roots turnout of McClintock's supporters to show support for their elected representatives.

On a Conservative-leaning facebook group of El Dorado county political minded citizens a post was made a week earlier about the coming meeting with this comment,

"Conservatives and/or Trump supporters, Let's get to this meeting and show the Congressman Tom McClintock that we have his back against the looney left."

Soon a grassroots movement formed to support both Tom McClintock and also to support President Trump's agenda.  Trump won the majority of votes in El Dorado county for his presidential campaign.  

The liberal-leaning SacBee reported of the event: 

"About two-thirds of those who filled the auditorium bleachers at Oak Ridge High came to express concerns about major policy shifts being pushed by President Donald Trump’s new administration. But this time, the town hall also drew a number of people there to express support for Trump and McClintock, including a contingent from the State of Jefferson, a conservative movement that advocates for a large swath of rural Northern California to break away from the rest of the state..."

The County of El Dorado is conducting this recruitment to fill one (1) full time vacancy in the Chief Administrative Office, located in Placerville, CA.  It will also establish a list which may be used for up to three months to fill future full time, part time, and extra help vacancies throughout the county.
 
A Training and Experience Evaluation may be utilized to determine applicant ranking and placement on the eligible list. Based upon responses to the supplemental questionnaire, the applicant's education, training and experience will be evaluated using a pre-determined formula.

DEFINITION
 
Under administrative direction, coordinates the work of specified County offices, divisions and departments, both elective and appointive, or a complex function within the Chief Administrative Office; analyzes and recommends policies and procedures related to the departments; and provides highly complex staff assistance to the Chief Administrative Officer and Assistant Chief Administrative Officer.
 
DISTINGUISHING  CHARACTERSTICS
 
The Deputy Chief Administrative Officer has responsibility for coordinating the activities of assigned departments that provide diverse services, or for a complex function within the Chief Administrative Office involving work performed for or by various offices, divisions and departments. The incumbent may be assigned to manage or oversee programs or divisions and perform the duties of subordinate staff and uncovered workloads within the Chief Administrative Office.
 

Examples of Essential Functions

 

Duties may include, but are not limited to, the following:

  • Coordinate the work of assigned County departments, divisions and/or offices, especially those activities, programs and projects involving multiple departments and internal services functions.
  • Direct the operations and personnel of internal service departments.
  • Consult with elected and appointed department heads concerning policy, administrative and operational problems in assigned departments.
  • Monitor and review operations of assigned departments for policy, fiscal, operational and political impacts.
  • Conduct, or assist with conducting policy, staffing and operational studies, primarily involving assigned departments.
  • Review, develop and coordinate the installation or implementation of new systems, projects, programs and procedures.
  • Assists with budget development and budget administration as requested
  • Provide support and supervision over selected policy, operational, personnel and fiscal matters within the Office of Chief Administrator; and assist in the preparation of the County budget.
  • Represent the Chief Administrative Office with the public on a variety of boards, task forces and committees and with other public agencies related to assigned departments; participate in outside community and professional groups and committees; provide technical assistance as necessary.
  • May assist as requested budget development activities including the development of expenditures and revenue projections.
  • May perform analytical activities for selected complex or major departments and/or projects.
  • May manage or supervise on either a continuous or intermittent basis, a variety of departments, activities and subordinate staff.
  • Build and maintain positive working relationships with co-workers, other County employees and the public using principles of good customer service.
  • Research and prepare technical and administrative reports; prepare written correspondence.

Where college degrees and/or college course credits are required, degrees and college units must be obtained from an accredited college or university. Courses from non-accredited institutions will not be evaluated for this requirement.

Equivalent to a Bachelor's degree from an accredited college or university with major course work in business or public administration or a related field AND five years of increasingly responsible experience in county government including two years of management responsibility.

In addition to the minimum requirements above, the ideal candidate will have the following highly desirable qualifications:

  • Masters Degree from an accredited college or university with major course work in business administration, public administration or a related field.
  • At least 3 years working in a County CAO or City Manager's office dealing with policy and legislative analysis.
  • Demonstrated experience and knowledge of principles and practices of transportation planning.

Former El Dorado County Fire District Employee Facing Assault Charge in Sonoma County

In subsequent years, he held a state license to work as an armed security guard, and his jobs included a stint with an El Dorado County fire district....His arrest and prosecution in connection with the Boyes Hot Springs incident, which resulted from a domestic violence call, could represent an unprecedented move in Sonoma County. Chief Deputy District Attorney Brian Staebell said there’s been no similar case in recent memory involving criminal prosecution of an officer for an on-duty incident."

A former Sonoma County Sheriff’s deputy who could face trial on a felony charge of assaulting a Sonoma Valley man he was trying to detain five months ago was hired by the county despite his checkered and limited job history with two other law enforcement agencies, a Press Democrat investigation has found.

Scott Thorne, 40, was arrested and charged in January with felony assault by an officer, marking an exceptionally rare case in Sonoma County involving prosecution of a law enforcement officer for an on-duty incident.

Thorne, a Walnut Creek resident, left the Sheriff’s Office within weeks of the Sept. 24 altercation, where prosecutors say he used a stun gun on the Boyes Hot Springs man as he lay in his own bed, then struck the man with his baton.

Thorne, who has pleaded not guilty, began his career in law enforcement 15 years ago, but before he joined the Sheriff’s Office in 2015, his work history as a sworn officer totaled less than two years, employment records obtained by the Press Democrat show.

His first policing job, in Richmond, ended after 10 months in 2002 while he was the subject of three complaints and a civil rights lawsuit. That case, also involving two other Richmond officers, resulted in a $172,500 settlement for the plaintiff, who accused Thorne of using excessive force on a domestic call.

In subsequent years, he held a state license to work as an armed security guard, and his jobs included a stint with an El Dorado County fire district.

He landed a job as a correctional deputy with the Los Angeles County Sheriff’s department in 2007, but he was dismissed a year later, records show.

Thorne was studying at the University of California Hastings School of Law in San Francisco when he was started as an unpaid reserve deputy in Sonoma County two years ago. He became a full-time, paid deputy in April.

His arrest and prosecution in connection with the Boyes Hot Springs incident, which resulted from a domestic violence call, could represent an unprecedented move in Sonoma County. Chief Deputy District Attorney Brian Staebell said there’s been no similar case in recent memory involving criminal prosecution of an officer for an on-duty incident...

On Sept. 24, Thorne and two other deputies went to a Highland Boulevard house to investigate a neighbor’s call about a loud argument. Once inside, one deputy interviewed a woman while Thorne went to a back bedroom where he found an uncooperative man unwilling to get off the bed. Thorne grabbed the man, deployed a stun gun, and when that was ineffective, hit him with a baton in the leg, authorities said...

The Boyes Hot Springs man hasn’t been identified by name. His Santa Rosa-based attorney, Izaak Schwaiger, said he’s a former Marine, honorably discharged, a former police officer and a “regular guy.”...

Schwaiger said the body camera videos from the deputies show Thorne created a volatile situation in the bedroom.

“He doesn’t ask a single question” when he comes into the room, Schwaiger said. “He kicks the door off its hinges, comes in the room, commands my client to get up. My client plainly says, ‘I’m calling my lawyer. I’m not being aggressive. I’m not doing anything wrong’ … and within seconds he’s being beaten.”...

His job as a Sonoma County deputy was Thorne’s third in law enforcement that ended within a year while he was still on probation, a trial period when the employer can terminate a new hire without cause. That means he left three policing jobs before earning a basic peace officer certificate from the state’s Peace Officer Standards and Training commission...

Mt Democrat has New Editor, but She is Not New to Local News

After years at the Georgetown Gazette, Penne Usher is now the editor of the Mountain Democrat, as well as the Georgetown Gazette.  Penne’s first Opinion piece as the new editor said, "I am pleased to join the Mountain Democrat team as the new editor.'

Penne Usher is the 33rd editor of the Democrat since it began production in 1851.  That is a new Editor every 5 years.  On Jun 17, 2015, NOEL STACK was named the new editor of the Mountain Democrat.  

In 2008 Usher left the news business and worked in marketing before returning to the Auburn Journal in 2014 as the managing editor, and shortly thereafter the editor.

She started her journalism career in 2002 as an intern at the Albuquerque Journal while she completed college at the University of New Mexico. Usher was a staff reporter for the Albuquerque Journal, working a night shift as a crime reporter before returning to California. She joined the Auburn Journal team in 2004 shortly after graduation (at 40) as the crime and fire reporter.

EID Announces Recycled Water Irrigation Workshop

The workshop will cover the District’s recycled water irrigation system and drinking water feature requirements.  There will be a review of the plan approval and inspection process to help prevent costly mistakes in the design and installation of the landscape irrigation and any water feature systems.

 All homeowners living in homes supplied with recycled water as well as designers and contractors working in dual-plumbed communities are required to attend an EID workshop before any design or installation begins.  All designers and contractors are required to attend a workshop every 18 months.

For a half-century, Saul Alinsky's "Rules for Radicals" has been the manual for left-wing activism. As a community organizer, Barack Obama implemented Alinsky's call for purposeful agitation with perfection. Hillary Clinton, who Media Matters' David Brock dubbed "Alinsky's daughter," wrote her thesis on his legacy. And to the militant left, her defeat signaled the need for a new set of tactics.
 
"The rule book has been thrown out," one "antifa" terrorist engaged in violence at the University of California, Berkeley told the Guardian.
 
Antifa (short for anti-fascism), the broad term for the new militant left, includes socialists, anarchists and anti-capitalists united by their street-fighting tactics and zeal for violence. BBC News compares them to white nationalists, but says antifa's "tactics are arguably more extreme." On online community Reddit, a headline on the Antifa section reads, "Every dead Republican is a step toward progress."
 
One common antifa tactic, black bloc, involves launching mob violence against people and property while dressed in black hoodies and ski masks. Their all-black uniforms serve a dual purpose: to intimidate their victims and hide their identities. The battle plan was executed flawlessly at the recent riots at UC Berkeley.
 
"This was a group of agitators who were masked up, throwing rocks, commercial grade fireworks and Molotov cocktails at officers," UC Berkeley Police Sgt. Sabrina Reich said.
 
The physical violence may have been directed at police officers, but the mob of antifa terrorists that violently attacked the UC Berkeley Martin Luther King Jr. Student Union earlier this year were as much declaring war on the ideology of the man for whom the building is named and its citizens. America's left was sending a message: Violence is the answer.
 
"Our side is growing and also prepared to be more politically militant and support more militant struggle," Yvette Felarca, a leader of the antifa terrorist organization, By Any Means Necessary, told Al Jazeera. "If the movement continues building as large and as powerfully in this direction, we can defeat Trump, his entire racist agenda, and get him out without waiting for the next election."
 
By any means necessary most often means violence against anyone who isn't radical enough. How extreme is antifa? Even members of the International Socialist Organization condemn their violence.
 
"They purposefully sideline the majority of the protesters and foreground their actions, giving everyone from the university administration to the corporate media to the right-wingers themselves an excuse to ignore the issues raised by the wider crowd, and shift their attention to the 'violence,'" Mukund Rathi, a contributor to Socialist Worker, wrote in a criticism of antifa's tactics.
 
Yet, antifa is becoming mainstream - normalized by college professors that incite imminent lawlessness and spread fighting words on campus. Last fall, a community college professor ordered all Donald Trump supporters to stand and be publicly identified for possible physical retaliation. An African-American member of the Sacramento State College Republicans was recently assaulted by a left-wing militant. At Cal State Fullerton, an anthropology professor is under investigation for assaulting a peaceful group of College Republicans. Left-wing protesters from Democrat-linked Indivisible recently stormed the offices of Rep. Dana Rohrabacher, knocking out a 71-year-old member of his staff.
 
"I can say, based on personal experience, that the attitude at demonstrations has changed," writes Malcolm Harris, an antifa sympathizer and editor for The New Inquiry. "Where masked and black-clad antifa used to get wary glares, now it's thumbs-up and 'right on!' from kid-toting parents."
 
Local law enforcement agencies lack the resources, capabilities or will to investigate this national network of militants. Following a half-million dollars in damage at UC Berkeley, just a single arrest was made, and not a single arrest on the night of the riot.
 
"How is it that after more than 100 thugs organized, well in advance, to invade the campus, and police were alerted to the risk of violence, again well in advance, no arrests were made the night of the attack?" asks University of Utah law professor Paul Cassett.
 
It's not enough for the FBI to provide assistance with the investigation into the UC Berkeley attacks. The U.S. Department of Justice should launch an investigation into this national network of violent militants. Such widespread and growing violence requires a well-financed support system. Many antifa websites solicit funds and organize black bloc attacks.
 
Until the Department of Justice takes down this organized criminal organization, it is incumbent upon all who believe in nonviolent political expression to stand up to these thugs. On campus, students must record and document these attacks. Civic leaders and elected officials must pressure local law enforcement officials to swiftly investigate and prosecute antifa members.

The exhibition displays 27 works of art, portraits, historic map and photographs, and other items of interest, from Wakamatsu farm.

 

Founded by Japanese colonists fleeing shogun-era violence, Wakamatsu is a unique part of El Dorado history. As the birthplace of the first Japanese-American has earned it special national status.
 

Included in the exhibition are rare Japanese woodblock prints from the period 1931 - 1957 that present contemplative scenes of farms, flowers, streetscapes, and views of Mt. Fuji. The works were lent by Charlie Downs and collected by Downs's father, Dallas Downs, in the course of his deployment during the Korean War.

Sen. Ted Gaines Talks About Massive Snowpack and California’s Water Supply

The California Department of Water Resources conducted their February snow survey, a measurement of the water content of California’s snowpack. This monthly survey is used to determine the amount of runoff the state can expect throughout the spring and summer. Typically, melting snow provides roughly 30-percent of California’s water supply. 

The snow survey showed that California’s stormy January was a drought-buster. The state is buried under a thick blanket of snow that will keep our reservoirs full all through the summer and make this a better year for recreation, agriculture, and for people who have had to cut back on personal water use.

But all this water also highlights that staggering lack of foresight and political will on the part of politicians who have neglected to build enough water storage to keep up with our growing population. The Sacramento River was recently surging with enough water every day to supply the needs of 150,000 families for an entire year. But instead of capturing that water in reservoirs it was being diverted into open fields or running out into the sea. 

It won’t matter how much rain and snow we get if we don’t have a way to store it and move it around the state. This extraordinary winter is a gift but we aren’t ready to accept it. I’m tired of delays. I want to see concrete and steel in the ground, workers and bulldozers in action so the next time Mother Nature opens up, California can capture the water it needs.

STATE WATER BOARD’S DECISION TO EXTEND DROUGHT

During a February meeting, the California State Water Resources Control Board made the decision to extend the state’s emergency drought regulations. By voting to extend the regulations, urban water districts will be subject to an additional 270 days of consumption reports, “stress tests,” and water-use cuts. 

This decision is blind to the snow survey results and the plain fact seen on every mountain, river and reservoir in the north state. We are flush with water, and they know that, but this lays bare their “permanent drought” plan that will let them limit and control water use forever to meet their environmentalist agenda.

There has been so much talk about “sanctuary cities” and “sanctuary states” lately, all relating to immigration. But now I’m convinced that California citizens need a sanctuary from unelected bureaucrats who won’t call off the drought when people are all but having to canoe to work because of the rain. 

The state needs to waive every rule, expend every dollar it has to get Sites Reservoir built and complete other surface storage projects so we can bank more of this water instead of letting it run out into the sea. Even a Sacramento bureaucrat with an agenda couldn’t fail to see the drought is over if we have more reservoirs filled to the brim.

Folsom Dam Safety a Concern after Oroville Dam Failure

I sent the following letter to President Trump requesting that – in light of the Oroville Dam crisis ― he take action to conduct an immediate and thorough inspection of Folsom Dam; the existing Folsom Dam spillways; the soon-to-be-completed auxiliary spillway; and all levees potentially affected by a dam failure or unregulated flow from Folsom Lake.

Dear Mr. President:

The Oroville Dam spillway damage and subsequent emergency spillway damage and potential flood crisis have placed California’s water infrastructure at the forefront of national news.

As serious as that situation was (and continues to be), my Senate District is home to Folsom Dam, which is a Bureau of Reclamation facility that provides flood control to the Sacramento Valley. This Valley region of the state is vastly more populated than the Oroville area and floodplain and a failure of the dam or its spillways would lead to grave consequences for hundreds of thousands, or possibly millions, of people.

Although we have been spared any Oroville-level crises, the dam and original spillway have been strained beyond designed capacity and, on at least one occasion, failed. In 1986, in a year of heavy storms such as those we are experiencing now, Folsom released roughly 15,000 cubic feet per second above the safe capacity of the downstream levees. In 1995, a spillway gate failed and released an unregulated flow of roughly 40,000 cubic feet per second into the American River. Thankfully, this latter event occurred in the summer when lake levels are not at their storm-swollen highest.

Folsom is currently in the final stages of adding another spillway complex to the lake’s infrastructure to provide additional flood-control capacity. I am thankful that the project is nearing completion and I’m hopeful it will add safety to the region.

However, as we recently witnessed in Oroville, it is possible that projects will not perform as they are designed to perform and that what appears to be a well-designed or well-maintained project may be suffering from latent defects that put people in serious jeopardy. 

Sacramento is one of the most at-risk flood areas in the country. As such, and in light of recent events in Oroville and the untested new auxiliary spillway soon coming on line, I am requesting that you task the Bureau of Reclamation, Army Corps of Engineers, or any other relevant and proper federal entities to conduct an immediate and thorough inspection of: Folsom Dam; the existing Folsom Dam spillways; the soon-to-be-completed auxiliary spillway; and all levees potentially affected by a dam failure or unregulated flow from Folsom Lake. These levees are a critical last defense for many people. Although I understand that they are not all federal, I am hopeful that your review could include multi-jurisdictional cooperation that resulted in a comprehensive review of this valuable infrastructure.

Lastly, I ask that if this review uncovers any problem that presents a danger to the people or property of California, that you waive or expedite any federal requirement that could delay the necessary remedy. I agree with you that this nation needs to renew its commitment to infrastructure investment and it can’t be delayed by unnecessary red tape.

Thank you for your leadership and concern for California and all the people of this great nation.

2017 Academic Decathlon - Oak Ridge Takes Title and Pondo Takes Top Individual

Teams from El Dorado, Oak Ridge, Ponderosa, Union Mine, Golden Sierra, and Nevada County’s Gidotti Early College High Schools competed for the opportunity to represent El Dorado County in the 2017 State Academic Decathlon Competition.

Interviews, speeches, and essay competitions were held on February 1st and teams wrapped up a full day of testing by competing in the Super Quiz on February 4th. Congratulations to Oak Ridge High School who scored 39,554.00 points to win the 2017 El Dorado County Decathlon! 

All of our team members performed exceptionally well, achieved personal and team goals, and a few students were at the top of the entire competition:

District Jazz Night

The El Dorado Union High School District’s (EDUHSD) Annual District Jazz Night was held on Wednesday, February 15th at Union Mine High School. The annual free concert highlighted the performances of four jazz ensembles within the District. Bands from El Dorado, Oak Ridge, Ponderosa, and Union Mine High Schools participated and gave their audience quite an impressive presentation. Great job to all of the bands on their outstanding performances!

The JAMZ All Star & School Nationals Competition was held in Las Vegas on February 17-19, 2017 at the Orleans Arena.

Congratulations to Ponderosa High School’s Competitive Cheer Team for placing 3rd in the Nation for Varsity Co-Ed Competitive Cheer! Your dedication, commitment, hard work, spirit, and teamwork really shined through during your performance. Out of over 1,900 band auditions from around the state, four of our EDUHSD students were accepted into the 2017 California All State Bands. Oak Ridge High School (ORHS) student, Joseph Diaz, was the 1st chair trombone in the All-State Wind Symphony. ORHS students Jeff Anderson (trumpet) and Nathan Culcasi (trombone) were accepted into the All-State Symphonic Band. Ponderosa High School (PHS) student, Andrew Maloney (oboe), was accepted into the All-State Concert Band. A special thank you to Santiago Sabado (PHS Director of Bands) and Paul Varoff (ORHS Director of Bands) for your leadership and guidance along the way. Congratulations to all honorees!

5 Ways Donald Trump Could Block Legal Marijuana in California

The Trump administration has made clear that it will not look the other way when it comes to de facto state legalization of marijuana, as the Obama administration did. Instead, White House press secretary Sean Spicer last week said the states that have approved the use of recreational pot – California is one of eight – would face a reckoning because marijuana use remains a federal crime under the Controlled Substances Act.

State Democrats immediately denounced the possibility of a federal crackdown and took a defiant tone, starting with Lt. Gov. Gavin Newsom, a key sponsor of Proposition 64, the ballot measure approved with 56 percent support in November that sets up the framework for legal pot sales and use beginning Jan. 1, 2018. Newsom released a letter that called Spicer “grossly uninformed” for saying legal pot could make the opioid epidemic worse and warned that a federal intervention would help “drug cartels and criminals” by keeping the sale of marijuana a black-market, illegal practice.

Xavier Becerra, recently installed as state attorney general, also vowed in a statement that he would “protect the interests of California” from federal intrusion.

A Los Angeles Times report quoted attorneys as saying California could argue that it has a legal right to control drug rules within its borders.

Constitution gives federal government final say

But legal websites and U.S. history suggest that a federal government that is determined to enforce federal laws would be a very difficult obstacle for a state to overcome.

“The Supremacy Clause is a clause within Article VI of the U.S. Constitution which dictates that federal law is the ‘supreme law of the land,’” the FindLaw website notes. “This means that judges in every state must follow the Constitution, laws and treatises of the federal government in matters which are directly or indirectly within the government’s control. Under the doctrine of preemption, which is based on the Supremacy Clause, federal law preempts state law, even when the laws conflict.”

A federal crackdown could come in several forms:

  1. Drug Enforcement Administration agents could stage raids on pot farms and dispensaries, as they did memorably in 2012 at Oakland’s massive Oaksterdam medical pot outlet. U.S. marshals and IRS agents joined in the raid.
  2. Federal authorities could warn property owners that their land and buildings would be seized unless they evict pot farmers or dispensaries.
  3. The federal government can compel cooperation through a lawsuit. An Associated Press analysis noted that this is what happened in 2010, when a federal suit forced Arizona to scrap an immigration law that the Justice Department said trampled on federal authority.
  4. The federal courts can also compel action, such as what happened last year in Kentucky, when a county clerk who objected to issuing licenses for same-sex marriage was overruled.
  5. The Treasury, Justice and Homeland Security Departments can all use existing laws to hammer banks and credit unions that accept deposits that can be linked in any way to marijuana-generated funds or if they provide any services to dispensaries. “Financial institutions face significant risk for violating federal law if they offer banking services to marijuana-related businesses,” an American Bankers Association web page warns. “The federal statutory barriers include the Controlled Substance Act, USA Patriot Act, Bank Secrecy Act, Racketeer Influenced and Corrupt Organizations Act and other federal statutes.” The RICO law in particular gives law enforcement wide latitude to classify activities that may seem in a gray area as illegal, which is why it’s long been a target of advocates of legal reform.

These five ways the Trump administration could crack down on a state attempting to legalize recreational drug use are only the short list. In an era in which sweeping executive orders have become the norm, Attorney General Jeff Sessions – an ardent foe of legal pot – could ask President Trump to withhold federal funds for law enforcement or health programs from defiant states.

While Spicer was emphatic about a new federal approach to state marijuana laws, he offered no timetables for action. Sessions has so far focused on other issues in his first weeks at the Justice Department.
