California May Lower Its Marijuana Taxes

Worried by a resilient black market that threatens to undermine California’s experiment with legal weed, state lawmakers are now considering a bill that would cut taxes on cannabis for a period of three years.

The proposed legislation, AB 3157, would reduce the state excise tax on marijuana from 15% to 11%. It would also suspend a $148-per-pound cultivation tax currently placed on growers.

Legal business owners argue the growing and excise taxes are too onerous, especially when combined with local taxes which can be as high as 9.2% in some parts of the state. By lightening the load, some lawmakers hope to give the newly-established legal market some much needed breathing room.

"Criminals do not pay business taxes, ensure consumers are 21 and over, obtain licenses or follow product safety regulations," said Assemblyman Tom Lackey (R-Palmdale),  who introduced the bill. "We need to give legal businesses some temporary tax relief so they do not continue to be undercut by the black market."

The City of Berkeley had the same thought in mind when it opted to lower its marijuana tax last month. The marijuana business license tax in Berkeley has been reduced from 10% to 5% in effort to help the legal industry compete and discourage the black market.

Voters established the 15% excise tax through Proposition 64, but the Legislature does not have to seek voter approval before amending the figure. As long as the move furthers the aim of the measure, Proposition 64 allows the Legislature to amend the tax with a two-thirds vote.

SOUTH LAKE TAHOE BIDS ITS CITY MANAGER FAREWELL

South Lake Tahoe says it has accepted the resignation of City Manager Nancy Kerry. The announcement was made on March 6, following a closed session meeting. Her departure concludes nearly six years as the city’s top administrator.

During her tenure, Kerry and the city’s executive team “developed an effective strategic business plan, guided economic development efforts that brought thriving new businesses to town, eliminated more than $60 million in debts and unfunded liabilities and strengthened the City’s financial status and community partnerships,” according to a city press release.

Mayor Wendy David thanked Kerry for her service and wished her the best in all future endeavors.

Kerry’s departure had been the subject of some speculation and innuendo, especially since a Feb. 6 decision to place her on indefinite leave. Now, Kerry hopes to clear the record.

"I hope with the conclusion of my service to the City, you will join me in remembering these past five to ten years with the fondness that comes with building a high-performing team, achieving a long list of goals and doing so with a passion and heart for the people of South Lake Tahoe," she said in a resignation letter that also called it a privilege to have served as city manager.

Kerry also reached out directly to CityNews to shed some more light on her experience leading the lakeside city.

“I’ve thoroughly enjoyed my time in South Lake Tahoe and during this time discussing my departure with the Council, I have been blessed to learn of the outpouring of support from the business community in particular. My time in South Lake Tahoe has been filled with wonderful experiences in a community where we strive to solve complex issues and focus on serving a community as vibrant and diverse as the landscape.”

Kerry continued that “it’s still not commonplace to see women in this position” and that she was pleased to have contributed to bringing new perspectives to the leadership of the city and among the profession.

Jeff Meston has been appointed acting city manager while the city searches for a permanent replacement.

Union Mine High Student Arrested for Making Threats

Yesterday, we received a report from Union Mine High School regarding a student who had made threats towards a group of students. 

Union Mine High School administration secured the student and contacted the El Dorado County Sheriff's Office. A School Resource Officer immediately began a thorough investigation into the allegations. After speaking with the deputy and school staff, the student was removed from campus and arrested for Penal Code 422(a)- Criminal Threats. 

The student was booked into juvenile hall. Due to the suspects age, their identification will not be provided.

Sheriff's deputies followed up the investigation by visiting the home of the student. 

No weapons or items of interest were found.

The El Dorado County Sheriff's Office takes threats to our community, schools, and students seriously. We thank Union Mine High School for their quick and appropriate reaction to these threats and their assistance during the course of this investigation. Currently, there are no other known or credible threats to Union Mine High School or any other schools.

Let’s fix what is broken - Political Opinion

The hottest buttons in our county and country is growth and outside influence on our election process.

As an El Dorado County small developer for 30 years I follow the rules and ensure that our county’s resources are protected while I build single-family homes on appropriately-sized lots.  But when I look to the western edge of the county I see dirt being moved in preparation for apparently massive development projects.  These projects create jobs and profits for out of the area developers, leaving our county with more congestion and traffic.

To understand what is afoot I reviewed the donations to our current slate of political candidates using the 460 forms at county elections department. Anybody can review them.

The District 4 Supervisor’s race has the two candidates receiving equal percentages of current funds from outside influences – about 10 percent of funds raised as of Dec. 31, 2017.  The recorder-clerk race has the two candidates who have raised funds both at around the 60 percent range of contributions from within our County.

Then, an enormous disparity shows up in the auditor-controller race.  Joe Harn, received an astonishing 95 percent of his funds for this election period from Out of the Area Developers.  His opponent obtained 99 percent of his contributions locally.  Going back to the 2014 race, Harn has received a stunning amount from developers in the last four years.

It is important to note that Joe Harn is on the County’s Development Agreement Negotiation Committee.  That appears to be an odd role for a county auditor, who should maintain an independent viewpoint to do the job.

So that means:

- Out of control growth at the western edge of our county;
- $100,000 in campaign contributions to a public official who negotiates developer agreements;
- Outside influence on our election process;
- A glaring example of pay to play – right in our back yard.
- This is a classic case of follow the money.  Do we want to continue this unethical and cozy situation?

My vote is for Mike Owen for auditor-controller.  Let’s fix what is broken.

Placerville Speedway Cancels Saturday's Opener Due to Wet Weather

PLACERVILLE, Ca. (March 22, 2018) – This Saturday’s scheduled championship opener at the Placerville Speedway has been canceled due to the major storm that has brought immense rain to the state of California this week.

Opening night at the speedway is now scheduled to take place on Saturday March 31 when the Sprint Car Challenge Tour presented by Elk Grove Ford and Abreu Vineyards invades the quarter-mile. Also on hand will be the BCRA Midget Lites. The Red Hawk Casino weekly championship battle will then get underway the following week on Saturday April 7 with “First Responders Night.”

“The wet weather over the last few weeks has definitely been a pain for everybody,” commented Placerville Speedway Promoter Scott Russell. “On the bright side our long-range forecast looks favorable for the Sprint Car Challenge Tour opener next week. I know that all the fans and teams are hungry for racing, so it should be a can’t miss night on March 31. We’re going to have a lot of sprint cars in the pits, along with the Easter Bunny and candy for the kids.”

Placerville planning to showcase its artistic side - A Banner Event

This June, Placerville will see its downtown streetscapes decorated by colorful banners in a project that showcases the works of local artists. 

Banners on Parade will be back for another year, and it will feature an assortment of pieces, with the major sponsor of the occasion being Images of Hope. It is organized by Placerville Art on Parade.

The banners are scheduled to be going up in early summer, and will be left up for the public to enjoy until autumn, when they will be sold during a silent auction that has been planned as part of the local Art and Wine Festival. For 2018, it will be the 14th year that area artists, businesses, individuals, organizations and government has come together in this collaborative effort.

To help the public get even more enjoyment from the event, brochures will be available at Main Street businesses. Note cards, postcards, bookmarks, magnets and posters that include images used on the banners will be offered for sale. Promotional products such as these can be produced by an area printer.

This local art event has been planned to run from June until October, and the auction of the pieces that were on display will take place on October 20. Anyone who would like to find out more about this community expression of its artistic side has been invited to visit the event’s website for additional details.

Morning Collision at Pleasant Valley Road and Mother Lode Drive Sends Man to Hospital

PLACERVILLE, CA  – A man was hospitalized following a two-vehicle collision Thursday morning in Placerville, the California Highway Patrol reported.
 
The collision happened around 9:35 a.m. at the intersection of Pleasant Valley Road and Mother Lode Drive.
 
While the cause and details of how the crash occurred were not immediately available, one person was hurt as result of the accident. The patient, identified as a 39-year-old Ryan Stock, was transported by paramedics to Marshall Medical Center with a complaint of pain.
 
There were no descriptions of any vehicular damages but both vehicles were towed away from the wreckage.
 
The full circumstances of the collision are under investigation.

Shingle Springs Car Crash on Highway 50

One person was seriously hurt Thursday afternoon when two vehicles collided in Shingle Springs, as per the California Highway Patrol.

The crash took place at about 3:07 p.m. Thursday, March 22, on U.S. Highway 50 at Shingle Springs Drive exit and involved a gold Toyota Tundra and a Ford Explorer.

Firefighters responded to the scene and confirmed that one person sustained major injuries in the crash. An air ambulance was requested to the scene to transport the injured party, police said.

Information regarding the identity of the victim was not immediately released.

The incident remained under investigation.

Humboldt County gearing up for Cannabis-Ordinance-2.0

County supervisors began discussions last week on a proposed ordinance that would overhaul existing marijuana rules in Humboldt County and expand the industry’s tourism sector.

The time for public comment on the proposed ordinance has been extended until March 28. It will come back for a vote on April 10.

Supervisors say the ordinance is necessary to bring clarity to local rules; mitigate some of the unintended consequences of the county’s existing ordinance; bring county regulations more in line with those of the state; and expand some facets of the commercial marijuana industry -- most notably, cannabis tourism. The draft ordinance also contains incentives aimed at bringing more existing cultivators out of the shadows and into the legal marketplace. Two of its most major provisions: reopening the permitting application process that closed December 2016 and capping the number of cultivation permits.

Each aspect of the plan has opened up a separate debate and discussion. There are significant questions about the validity of the environmental impact report that was conducted, for instance. Representatives from the Yurok and Karuk tribes, Friends of the Eel River, and the state Department of Fish and Wildlife all addressed that issue during the March 19 meeting and urged the county to revise its analysis before permitting any additional grows.

Even bus stops commanded a fair share of attention during last week's meeting. Industry advocates say an existing provision that prohibits cannabis businesses within 600 feet of school bus stops, churches, or schools has become a large barrier to licensing. The board directed staff to submit options to revise the bus stop setback.

OC Supervisors Fighting California's Sanctuary State Law

Orange County looks poised to join the fight against California’s new sanctuary state law, SB 54. On Tuesday, the Board of Supervisors will consider taking legal action against the state or asking the county counsel to join the federal government in its existing lawsuit targeting SB 54.

Supervisor Shawn Nelson announced the proposal Thursday in response to his colleague Michelle Steel’s calls for a resolution condemning SB 54. This law "prevents law enforcement from removing criminals from our community and is a threat to public safety,” Nelson said.

Nelson and Steel’s actions came just days after one of Orange County’s smallest cities, Los Alamitos, voted to exempt itself from SB 54. As CityNews noted, a number of other cities are now considering similar legislation

Starkes Grade Road Closed a Month for needed Repair

(PLACERVILLE, CA) – El Dorado County Department of Transportation today announced the full closure of Starkes Grade Road between Campini Way and Five Spot Road beginning Monday, March 26, 2018 through May 25, 2018, weather permitting.

“Last winter was the worst winter in 20 years, in terms of damage to the 1,080 miles of County roads,” said Rafael Martinez, Department of Transportation Director. “While the closure is a temporary inconvenience to residents and motorists in that area, we must make the repairs to ensure the road’s safety for travelers.”

Temporary repairs were made to this stretch of road last June and the County noted then that a permanent fix was forthcoming.

Repairs include removal all of the unsuitable material under the previously failed roadway section on Starkes Grade Road, construction of a mechanically stabilized embankment (MSE) wall, construction of an extensive drainage system, and reconstruction of the roadway structural section.

Changeable message signs placed in the vicinity last week provide notice of the length of closure. They are located at Starkes Grade/Campini Way and at Starkes Grade/Sly Park Road. Residents on the west side of the closure will access their homes from Newtown Road to Starkes Grade. Residents on the east side of the closure will access their homes following the detour of Sly Park Road to Starkes Grade Road.

“The full closure of Starkes Grade Road will make it safer for the construction workers and will effectively reduce the time it takes to construct the project, ultimately reducing the time the public will be inconvenienced,” said Martinez.

Department of Transportation understands the inconvenience that motorists face while this closure is in place and sincerely appreciates your patience with this matter.

County launched new website that provides Road updates on Storm Damage, Maintenance, and Projects

(PLACERVILLE, CA) – El Dorado County today launched a new website dedicated specifically to road work projects that have been completed, are currently being done, or are slated to begin this calendar year. Of the 100 projects listed, 58 are maintenance projects, 28 are storm damage projects, and 14 are capital improvement projects. These projects collectively account for nearly $100 million in cost to complete.

“One of the issues of concern to most County residents is the condition of our 1,080 miles of roads. This new website allows residents to easily see where progress has been made, what’s coming up in terms of road repair and what’s currently under construction,” said Department of Transportation Director, Rafael Martinez. “It also provides users with funding information and a timetable for estimated completion of most projects. It will be a constantly evolving site as our employees work to make the roads safe in our County.”

The site contains an interactive overview map of the county with each project marked with different icons indicating whether the project is related to storm damage repair, maintenance or capital improvement and where it is along the continuum of construction.

When a user clicks on an icon, the page moves to screen that provides the project description, estimated cost, estimated construction date (or completion) and the funding source. Many of the projects also include images of construction. Additionally, when a user selects a project, a second map appears on the right side of the screen that displays a zoomed-in location of the larger map highlighting the precise location of the project. Finally, users can also search for projects by name.

Because of the complexity of the mapping features, the functionality of the site works best on Chrome rather than Internet Explorer.

“This website is another tool the County is using to be transparent, keep residents informed and even provide additional information that they may find useful.
