The Era of Legal Adult-Use Cannabis Business Begins - But Not in El Dorado County

December 29, 2017 - Placerville, CA The era of legal cannabis sales begins in California Monday, in some parts of the state, but not in El Dorado County. County residents who want to purchase adult-use cannabis or see a cannabis farm January 1st, 2018 will find “Nada nothing,” says, Rod Miller with the El Dorado County Growers Alliance [https://www.facebook.com/groups/1459211690844088/].

Despite months of community and Board of Supervisors meetings the County has yet to come up with a permitting system that allows adult-use retail sales and cultivation.  “County residents will be taking their 100s of millions of dollars and the resulting jobs to other jurisdictions. The County developed fines but no legalizing permits for the County’s 1000s of existing cannabis growers,“ states Erin O’Neil President of the El Dorado County Growers Alliance.

“Cannabis could be an instant gold rush for El Dorado County, known for its ideal growing conditions and gold discovery history,” suggests Miller.

“The County has many unmet needs that cannabis business, tax and fee revenue can provide, such as, rural jobs, rural ambulances, pothole filling, homeless housing and addiction education in schools,” states Miller.

“We have intelligent Supervisors and County staff that can quickly create a legal market for adult-use cannabis to compete against the black market. County residents want access to adult-use cannabis similar to the access they enjoy to the County’s wineries,” said Miller.

The State began in mid-December approving temporary adult-use licenses for businesses in jurisdictions that approved local permitting programs.  When the temporary licenses expire businesses will have to re-apply for annual licenses.

“The County cannabis growers and retail businesses have something to prove,” asserts Miller, “that they will be environmentally and community responsible businesses.  Let us prove it.”

Emergency Work Requires Daytime Traffic Control on Hwy 49

Drainage Work to Start on State Highway 49 near Auburn

EL DORADO COUNTY — One-way traffic control will resume on a section of State Highway 49 in El Dorado County next week for drainage work. While inspecting a slipout of a section of the northbound lane of the highway about halfway between Cool and Auburn, Caltrans engineers also identified two culverts that weren't functioning correctly. Those culverts will be filled and a new 30-inch pipe will be installed along with a drainage inlet to keep stormwater off the highway. 

Work will start Tuesday, January 2 and is expected to be completed by Friday, January 12, weather permitting. The schedule will be Monday through Friday from 7 a.m. to 3:30 p.m., with flaggers handling reversing one-way traffic control. Motorists should expect delays of up to 20 minutes. 

Doug Veerkamp Engineering, Inc.. the company that performed the previous work to stabilize the slope with a 160-foot retaining wall, will again be the contractor. 

Work on another section of Highway 49, about two miles north of Placerville, started this week. An existing culvert in poor condition has been removed and a new one will be installed. About 100 feet of roadway embankment and pavement will be rebuilt and rock slope protection installed. 

The schedule also is Monday through Friday from 7 a.m. to 3:30 p.m. with one-way traffic control, and the project should be completed by Friday, January 12, again weather permitting.

The Medicine Horse Project Strives to Save Body and Soul

We would like to introduce you to "The Medicine Horse Project" organization located in Somerset, California.  

The Medicine Horse Project is a 501(c)3 non-profit organization that is dedicated to the rescue and rehabilitation of displaced, abandoned or slaughter bound horses.  Because we understand the incredible healing power these animals hold, our mission has a focus on healing not only horses but humans as well. We partner rescued horses with humans seeking healing, empowerment and resilience.

It is an incredible partnership when you introduce a horse that had been given up on by  people to a human who has maybe given up on themselves.  If breeds hope, healing and recovery.

My husband and myself took over the operations and programs of the Caliente based organization early last year.  Moving into 2018, we have a new Board of Directors and we are charging forward in building our programs and moving the headquarters fully to Somerset.

This past year, we have rescued 7 horses, adopted out 3 horses and offered many horsemanship workshops, women's empowerment retreats as well as at risk youth outreach.

CCW Pistol Drawing To Help Elect Dellinger hosted by Taxpayer Watchdog Committee

GRANTS TO LIMITED-INCOME SENIORS FOR HAZARDOUS TREE REMOVAL STILL AVAILABLE

(PLACERVILLE, CA) – Funding is still available for eligible seniors living in high hazard areas specific to tree mortality, including South Lake Tahoe, Camino, Pollock Pines, Somerset, Garden Valley, Greenwood and Georgetown. Depending on their situation, low-income senior citizen property owners may benefit from the County’s Hazardous Tree Removal Program.

“The tree mortality issues in our county remain very serious. Recent reports estimate a growing number of effected trees in El Dorado County. We’re just happy to have this program available to assist private homeowners, especially our seniors with limited income who have no other means to remove dead or dying trees from threatening damage to their homes,” said Supervisor, Michael Ranalli, who is the Board’s representative on Governor Brown’s Tree Mortality Task Force.

All applicants must be 60 years of age or older, own the property on which they reside and have incomes at or below 60% of the County’s area median income.

Funding for the program comes from a California Department of Forestry (CALFIRE) and Fire Protection State Responsibility Area Fire Prevention Fund (SRAFPF) and Tree Mortality (TM) Grant. El Dorado County received approximately $200,000 to help senior citizens, remove dead and dying trees that endanger their residence.

To meet the criteria under the Program, dead and dying trees must be:

1) greater than 10 inches in diameter and 20 feet in height;

2) must be within 300 feet of, and pose a structural threat to, the residence; and

3) must also be reasonably accessible by equipment or machinery.

“The County estimates the funding received from CAL FIRE could remove up to 42 trees, hopefully more. For now, we’ll be limited to removing two (2) trees per property” said Creighton Avila, Deputy Chief Administrative Officer. “Preliminary inspections have begun,” said Avila, “but there is still time to submit an application to participate in the program.”

Qualified homeowners must complete an application packet available from the County which asks for documentation concerning employment and income sources to establish eligibility for Program participation. Completed applications will be accepted on a first-come, first-served basis.

Trump Dedicates January to Fighting Human Trafficking

A new year signified fresh starts and new opportunities!

President Trump has decided to take a fresh approach at combatting human trafficking and designated January of 2018 as the “National Slavery and Human Trafficking Prevention Month.”

Trump released a proclamation on December 29, which announced that January will be a time for our country to issued Dec. 29, “recommit ourselves to eradicating the evil of enslavement.”

“Human trafficking is a modern form of the oldest and most barbaric type of exploitation,” it said,  “It has no place in our world.  This month we do not simply reflect on this appalling reality.  We also pledge to do all in our power to end the horrific practice of human trafficking that plagues innocent victims around the world.”

The Hill reports: 

Former President Obama made a similar proclamation during his presidency, designatingJanuary 2017 as National Slavery and Human Trafficking Prevention Month. Obama alsosigned anti-human trafficking legislation in 2015 to provide services and protections for trafficking victims.

 

Trump announced that in January, he will sign into law two anti-trafficking bills, the “Combating Human Trafficking in Commercial Vehicles Act” and the “No Human Trafficking on Our Roads Act.”He also touted several ways his administration has moved to combat human trafficking, such as signing an executive order last February to dismantle international crime organizations and setting up an interagency task force on working with other nations to combat trafficking.

 

Trump has repeatedly lamented rising crime rates in the U.S., despite evidence that crime isat a low, particularly in big cities.

 

“The Department of State has contributed $25 million to the Global Fund to End Modern Slavery, because of the critical need for cross-nation collaborative action to counter human trafficking,” the proclamation continued,  “The Department of Labor has released an innovative, business-focused mobile app that supports private-sector efforts to eradicate forced labor from global supply chains.”

Secret Sexual Misconduct Settlements Will Roil California in 2018

No doubt there are many on Capitol Hill in Washington, DC, and in state capitals across the nation that are somehow hoping that the distraction of Christmas and New Year's Day will somehow change the channel on the intense scrutiny of sexual harassment (or worse) committed by politicians of both political parties.

That's not going to happen. In fact, I predict that the high profile that this issue has taken over the past few months is just a harbinger of things to come as the holidays come to a close.

We have seen members of the U.S. Senate and House resign, or announce retirements.  We have seen state legislators do the same.  Here in California we have seen resignations from Assemblymembers Matt Dababneh (D-Los Angeles) and Raul Bocanegra (D-Arleta) already.  The resignation of the former has placed a lot of negative scrutiny on U.S. Rep. Brad Sherman (D-CA), for whom Dababneh served as district director.  A third Assemblymember, Sebastian Ridley Thomas (D-Los Angeles), just this week announced his sudden resignation, citing health reasons - after his name had been whispered as someone else who might end up in the spotlight on this issue.  California State Senator Tony Mendoza (D-Artesia) is considered by many to be politically a dead man walking as multiple credible accusers have made serious allegations about him - and he has been suspended from all of his committee assignments as a formal investigation takes place. Another Senator, former Assembly Speaker Bob Hertzberg (D-Reseda), is also the subject of an investigation as well.

The reason the issue is a powder keg that has not really blown up yet is the secret-taxpayer funded settlements.  In the U.S. Senate and House, it has been revealed that millions of dollars have been spent settling sexual harassment issues coming straight out of the offices of federal legislators.  In some cases, these secret settlements have taken place using money from individual office budgets; in other cases, payments have been made from funds controlled by the institutions (so presumably, ultimately, leadership).

Similarly, in the California legislature we have learned that significant sums of taxpayer money have been spent on sexual harassment claims made against elected.

No one that I have spoken to regarding secret settlements - and I have spoken with many - thinks that this is okay. In fact, most get downright angry when they hear about it.  For two reasons, mainly.

The first: if money is being paid out to someone who filed a claim there is a presumption that the claim was meritorious, and that the public has a right to know when one of their elected officials has been found to be conducting themselves inappropriately, or worse.

The second: these are public dollars and the public has the right to know where their dollars are being spent.

Adding to the considerable cost of these secret settlements themselves is now the fallout from resignations - i.e. special elections, and their significant cost to taxpayers.

It seems that there are two main groups of politicians who are interested in slow-walking or ideally never revealing the truth behind secret settlements.

Of course there are the sleazy politicians who know that if and when the news breaks that they had sexual harassment allegations so credible against them that victims had to be paid off - well, as we have seen, these have been extinction moments for most.

But then there are the enablers: those that have not actually committed and untoward or sleazy actions themselves, but they are covering up for those who have done so.  That means those who are in a position to open the books - to provide transparency.  Presumably this is leadership in Washington and in Sacramento - both elected leaders, as well as those legislators heading up key administrative committees with oversight over such matters.

Frankly, every federal and state legislator should be putting out a statement calling for transparency and for making the secret settlements public - as well as stating on the record that they have not had any issues themselves. That would create significant peer pressure.

There are efforts both in the national and state capitols to shine the light on settlements.  In D.C. a legislative effort is being spearheaded by Rep. Ron DeSantis (R-FL). In Sacramento, the Senate Republican Leader, Pat Bates (R-Laguna Niguel), has called for more transparency.

Legislators that are not affirmatively trying to open up the books, and shine the light on secret settlements, are in fact part of the problem.

The war drums on this issue are only getting louder and louder - and the new year will bring a new national drive for transparency and accountability.

This entire episode has emerged as a painful stain on our political system (and as an ugly cultural black eye, as stories continue to emerge across the country outside of politics).

But this is not without a considerable upside.  Change needs to happen.  It's not alright for people with power to engage in sexual misconduct - period. It's not appropriate, nor humorous, in any context.

New Year Starts with Boom - at illegal Butane HASH Extraction Lab

On January 1st, 2018 at about 1525 hours, El Dorado County Fire responded to an explosion heard at a residence in the 5100 block of Pony Express Trail in Camino.  A short time later, fire personnel requested El Dorado County Sheriff's Office to respond to the scene for a possible butane extraction lab explosion. As Sheriff's deputies and detectives responded to the scene, medical personnel treated Joshua Jamison (39) from Camino for burns to his face.  Jamison was transported to a local hospital for his injuries; he has since been treated and released.  A juvenile was also transported to the hospital for possible smoke inhalation and was later released.  Two other juveniles were found to be inside the home when the explosion occurred and they were uninjured.

El Dorado County Sheriff's Office detectives and an El Dorado County arson investigator began looking into the nature of the explosion and were quickly able to determine that it was the result of an illegal butane extraction lab that was being done in the bathroom of the home.  The illegal lab was being used to produce concentrated cannabis. There was extensive structural damage to the home as a result of the blast.  Many interior walls were cracked or moved and multiple exterior walls were pushed off of the foundation.  El Dorado County Code Enforcement was called and has deemed the home unsafe to occupy.

El Dorado County Sheriff's Office detectives conducted interviews of the residents of the home and a search warrant was served at the location.  Numerous items of evidence in support of a butane extraction lab were collected per the search warrant.   This is an ongoing investigation with the El Dorado County Sheriff's Office, El Dorado County Fire, CPS and Code Enforcement. The case is to be forwarded to the El Dorado County District Attorney for review and no arrests have been made at this point.

Strong Partnerships Feed Families in Need

One of the remarkable things about El Dorado County is our capacity to work together for those in need. Every year, community groups from different sectors take time out of their busy holiday schedules to provide food to families who need it most. This December, 100 families with children in the El Dorado County Office of Education’s (EDCOE’s) Child Development programs, received large boxes filled with enough food for a holiday feast and plenty of leftovers. “Thank you to the county agencies, businesses, volunteers, and EDCOE Child Development team members for making this program possible for our families,” County Superintendent of Schools, Dr. Ed Manansala, expressed. 

To raise funds to fill the boxes, the El Dorado County and Shingle Springs-Cameron Park Chambers of Commerce hosted their annual Holiday Luncheon and Gift Basket Auction. Community leaders filled Henry’s Steakhouse at Red Hawk Casino and bid on dozens of donated baskets, elegantly displayed around the room by EDCOE leadership members. Mary Viegas, Executive Director of Child Development Programs, walked baskets around for bidders to see.  She added, “It is always amazing to see the generosity of the El Dorado County and Shingle Springs-Cameron Park Chambers of Commerce. This year, they raised $7,650! Thank you to Red Hawk Casino for providing the beautiful lunch, to the Chambers for organizing this event every year, and to those who bid to benefit others! It means a lot to our families and students!”

El Dorado County Chamber of Commerce Chief Executive Officer, Laurel Brent-Bumb, directed the luncheon and noted, “It brings the chamber family such joy to see the generosity of members and friends. It is such a comfort to know that families in need will have a better holiday season.”

Money raised at the auction, along with additional donated funds, was used to purchase pallets of food. Then, the EDCOE Child Development Program team along with the ‘Don Andrews Lunch Bunch’ volunteer group, sorted food into large boxes for the families. This group of friends has donated time and their own funds over the last 30 years because they simply wanted to do something special for the community without expecting any recognition in return. 

Brenda Higgins, EDCOE Food Services Supervisor, helped orchestrate the food sorting and box distribution. She acknowledged that “we were able to purchase much more food this year than in years past because of the support we received from Save Mart Grocery – they were amazing to work with. The EDCOE Child Development coordinators make the distribution of all of this food possible including 28 boxes that went to Tahoe. Many of the families come to EDCOE for their boxes, and some walk through that door with nothing at all. However, if they cannot come here for their box, we make sure they receive their food.”  

Tanya McBride, who currently has a daughter in an EDCOE preschool program and received a food box last year, addressed the Chamber Holiday Luncheon and emphasized the impact of this collaborative effort, “The box we received last year gave me the ability to purchase other necessities and a few Christmas gifts for my daughter. The box made the holidays a joyous time for our family, and I’m still very grateful to you.”

Teen Court in Placerville Invites New Participants

(Placerville, CA) - El Dorado County youth in grades 8 through 12 are invited to take an active role in the juvenile justice system through the Teen Court program. Training is mandatory for all new and returning participants. Teen Court volunteer training will be held on January 17, 2018, from 6:00 p.m. to 8:00 p.m. at El Dorado County Superior Court, located at 495 Main Street in Placerville. After completing training, teens serve as court personnel in real cases where a minor has committed an offense, admitted the offense, and has chosen to be judged for sentencing by their peers. 

"This is a unique opportunity for youth in our community," said Stephanie Carlson, Health Education Coordinator with Teen Court. "Students serve as jurors, attorneys, court clerk and bailiff. Superior Court judges preside over Teen Court, and adult attorneys serve as mentors, donating their time to help students develop cases. Students get a real understanding of the juvenile justice system. Defendants get a fair and appropriate sentence through responsible consideration by their peers. It is not about punishment, but a chance to gain a better understanding of the offense and the consequences of their actions."

Youth interested in serving on Teen Court must attend the training on January 17, 2018. Parking for the training is available in the local area, including a parking garage. Walking to the Court House may take a few minutes. Sign-in begins at 5:15 p.m.; students are asked to arrive at the Court House no later than 5:30 p.m.

Pre-registration for the training is not required. Students must be El Dorado County residents and enrolled in grades 8-12; private school and homeschooled students are also welcome. Teen Court hearings will be held February through May 2018, on scheduled Wednesday nights. A hearing calendar will be provided to the students.

The highly successful Teen Court program began in 1992 in El Dorado County and is funded through the El Dorado County Health & Human Services Agency, Behavioral Health Division, Alcohol and Drug Programs. Cases are referred and managed by the El Dorado County Probation Department. The County Superior Court Judges, the Sheriff's Office, the local Bar Association and local attorneys are important program partners. District Attorney, Local Schools, and Law Enforcement Partner in Project LEAD

El Dorado County District Attorney Vern Pierson is pleased to announce the conclusion of one of the most consequential trials of 2017 in El Dorado County... People v. Tracy Smith, a mock trial conducted entirely by fifth-grade students from Sierra School in Placerville and Blue Oak Elementary in Cameron Park. 

The mock trial wrapped up another successful round of Project LEAD, a law-related education program that teaches fifth grade students about the legal and social consequences of juvenile crimes.  This semester, prosecutors and law enforcement partners from the El Dorado County Sherriff's Office, Placerville Police Department and the El Dorado County Probation Department collaborated with educators from two classes at Sierra School and one class at Blue Oak Elementary.

In the past three years, the District Attorney's Office has conducted Project LEAD in a total of eight different classrooms. Next semester, the program will continue at Sierra School and Blue Oak Elementary, and will expand to classes at Sierra House Elementary in South Lake Tahoe and Lake Forest Elementary in El Dorado Hills.

As Fredrick Douglas said, "It is easier to build strong children than to repair broken men." Project LEAD is just one of the many ways that the members of the El Dorado County District Attorney's Office, along with many of our other justice partners, reach out to the youth in our community to help build a stronger future.
