Local Assemblyman Kevin Kiley Works to Close Rape, Child Abuse, and Violence Against Elders Loopholes in Prop. 57

EL DORADO HILLS - Assemblyman Kevin Kiley (R-Roseville) has introduced his first two bills since election to the State Legislature. Assembly Bill 197 adds child abduction for prostitution, animal cruelty, and violence against elders to California’s list of violent crimes. Assembly Constitutional Amendment 3 transfers from the State Attorney General to the nonpartisan Legislative Analyst’s Office the power to draft ballot summaries for initiatives.
 
“Proposition 57 was passed last year, and gives ‘non-violent’ felons eligibility for early release from prison. Unbeknownst to most voters, the initiative’s definition of ‘non-violent’ includes rape by intoxication, forms of child abuse, and violence against elders.” Kiley said. “The legislation I’ve introduced will address the consequences of Prop. 57 and ensure that voters are never deceived again.”

The introduction of AB 197 follows the introduction of Assembly Bill 27 by Melissa Melendez (R-Lake Elsinore) and Lorena Gonzalez (D-San Diego), which would classify rape by intoxication, rape of an unconscious person, and spousal rape as violent crimes.

Sexual Assault - Sheriff’s Office is Asking for Communitys' Help Identifying Person

[EDSO Sergeant Tasha Thompson]  On January 27, 2017, at approximately 1:00 PM, an El Dorado County resident was walking on the bike trail, located near Missouri Flat Road, with her child in a stroller.  A male approached her from behind and asked her about the location of a nearby business. The male asked for a dollar and asked to shake her hand after she gave the dollar to him. When the male grabbed a hold of her hand, he pulled her in close and used his other hand to sexually assault her. The male continued to hold on to her as she screamed for help and began fighting back. He then released her, apologized, and ran south from the trail. While running away, the male lost his shoe which was later collected by the Sheriff’s Office.

The male is described as being 14 to 20 years old, a dark skinned Hispanic, standing approximately 5’7” tall and weighing 130 pounds. The male had dark hair and brown eyes. The male’s hair was described as messy, with two to three inches in length that stood straight up. The male was wearing a “sky blue” short sleeved polo shirt, blue jeans and red Nike shoes.

The El Dorado County Sheriff’s Office is asking for the communities help in identifying this person. If the description sounds familiar to a person you know, please contact Detective Anthony Prencipe at (530) 642-4709.

Detectives are currently reviewing video surveillance in the area and hope to provide a picture of the person in the future.

Senator Gaines - RECOGNIZING UBER DRIVER KEITH AVILA for Fighting Human Trafficking

I was honored to welcome Keith Avila, the Uber driver who saved a teen from being sex trafficked, at the State Capitol where I presented him with a Senate Resolution recognizing his heroic efforts.

On December 26, 2016, Keith arrived in a Sacramento neighborhood to pick up three female passengers. One of them was a minor who wanted to be taken to a hotel in Elk Grove. During the trip, Keith overheard a conversation that convinced him that the very young-looking woman was about to be pimped by her two older companions. After he dropped the women off at the hotel, he did what many others may not have done. He took immediate action and alerted the Elk Grove police. Thanks to Keith’s accurate assessment of the situation and his willingness to become involved, the two older women were arrested, charged with pimping and pandering and jailed. The 16 year old runaway teen was provided with shelter and assistance. 

Human trafficking is a form of modern-day slavery that affects an estimated 800,000 victims a year globally and an estimated 15,000 to 17,000 Americans. That is why I introduced Senate Concurrent Resolution (SCR) 15, which proclaims the month of January 2017 as Human Trafficking Awareness Month. 

Through public education and awareness, we may be able to identify victims and restore their individual freedoms as well as their physical, mental and emotional state.

A number of organizations and law enforcement throughout the state and country are working tirelessly to provide the needed resources to combat human trafficking and prosecute perpetrators of these egregious crimes. 

As with anything, much more can be done and it is important to continue the discussion and bring this serious issue that exists in our country out from the shadows and into the light. 

This is one of the most unifying social justice issues of our time. May we continue to work every day to fight to eradicate this evil from our communities and from the world.

Flushable Wipes Not Actually Flushable Warns EID

[EID] Remembering to NOT put these items in the toilet will help keep the sewage flowing down in the right direction and save you potential costly repairs.

10 Items to Never Toss in the Toilet

1. Cotton Balls/Q-Tips

You may think that cotton is flushable since a lot of toilet paper is made from cotton linen (Cottonelle/Cottonsoft), but it isn’t! Cotton balls, Q-tips, and cotton rounds will clump together in your pipes and cause a clog.

2. Paper Towels

Paper towels are tough and not made to dissolve in water. Even the biodegradable kinds are not meant to be flushed, throw all paper towels in the trash, not the toilet.

3. Dental Floss / Hair

Dental floss is not meant to dissolve in water, so it will end up getting stuck and tangled in pipes and sewage systems. Another stringy material, hair, has the same propensity to cause clogs.

4. Facial Tissue

Like paper towels, tissues are made to be much stronger than toilet paper. Toilet paper is a specially designed product made of shortened fibers to speed up the process of disintegration. Try washing your hands with toilet paper compared with tissues or paper towels and you’ll recognize the difference.

5. Flushable Wipes (Not Actually Flushable)

Flushable wipes cause the biggest trouble for toilets and septic systems since so many people use them and think that they are “flushable.” As a result, there have been public awareness campaigns, lawsuits, and countless stories of the problems they cause for sewage treatment centers. Brands are now being forced to remove the “flushable” and “disposable” labels and warn consumers not to flush them. We understand their appeal, but just like tissues and paper towels, remember to throw these in the trash.

6. Bandages

Many bandages contain plastic and/or cotton which is not biodegradable. Throw these in the trash, where they belong.

7. Diapers

Diapers are thick and can expand and cause a major pipe clog, usually in the U-bend. Even the biodegradable kinds will tell you not to flush them. Throw the diapers and wet wipes in the trash.

8. Pills / Prescriptions

Any drugs, including pills, should never be flushed down the toilet. This isn’t so much a clog concern, but rather an environmental one. Sewage systems have complicated biological processes to break down waste and medications can interfere with that. Most medications cannot be removed from the water, so they end up in our lakes, oceans, rivers, and ponds.

9. Cat Litter

Although some litter brands may market themselves as flushable, others can expand to 15 times their normal size and clog your pipes. Additionally, cat feces contain a parasite call toxoplasma gondii, which cannot be broken down by sewage systems and can enter the oceans and cause harm to wildlife. This goes for all pet excrement.

Although there is no perfect way of getting rid of litter, we recommend scooping it into biodegradable baggies and throwing them in the trash.

10. Feminine Products

Most public restrooms have signs and little disposal bins to encourage women to throw away, not flush, their feminine products. Like the other cotton items on our list, tampons will expand and cause clogs. Just don’t do it, ladies.

And here are a few more to add to the list of trash not flush items:

  • Paint/Sealants/Thinners
  • Oils/Grease/Food/Coffee Grounds
  • Condoms
  • Poisons/Hazardous Waste
  • Cigarette Butts
  • Anything Plastic

Pondo pups on site to hang out with all the 8th graders checking out all Ponderosa High school has to offer for them next year....

Gotta love a high school with piglets, rabbits and baby goats mixed in with key club, sports and of course our guide dog puppies! 

We got close to 30 families interested in the FFA program. 

Raisers did such a great job describing who we are, why we do what we do and what Guide dogs for the Blind are all about!

Sucktion Dredging Ban In Cal in Conflict with Fed Law say PLF in Supreme Court case

Nearly two centuries ago, the Supreme Court recognized that the “unavoidable consequence” of the Constitution’s Supremacy Clause is that States have “no power … to retard, impede, burden, or in any manner control” federal policies that are otherwise consistent with the Constitution. California, unfortunately, has forgotten this important history lesson and needs the Supreme Court to give it a refresher.

PLF has filed a petition asking the Court to review a challenge to California’s broad suction dredge mining ban. Our client, Brandon Rinehart, is a California miner who was criminally prosecuted for engaging in an activity on federal land that federal law encouraged him to do. His conviction under the state mining ban irreconcilably conflicts with federal policy.

The Mining Law of 1872 declares federal lands “free and open” to mining. The Supreme Court hasconfirmed that “[t]he obvious intent was to reward and encourage the discovery of minerals that are valuable in an economic sense.” Nearly a century later, Congress itself reaffirmed the nation’s “continuing policy” to encourage “the development of economically sound and stable domestic mining.”

Under our Constitution, “any state legislation which frustrates the full effectiveness of federal law is rendered invalid.” States have no authority to erect “obstacle[s] to the accomplishment and execution of the full purposes and objectives of Congress.”

Yet that’s precisely what California has done by banning mining. Rather than regulating mining’s environmental impacts, the state imposed a blanket ban on this federally encouraged activity. Obviously, that undermines Congress’ purpose in encouraging mining.

 

Nevertheless, the California Supreme Court upheld the ban against Rinehart’s challenge, breaking rank with every other court to consider the question. The Eighth Circuit,Federal Circuit, and Colorado Supreme Court have all held that a state goes too far when it “seeks not merely to supplement the federal scheme, but to prohibit the very activities contemplated and authorized by federal law.” The California Supreme Court also thumbed its nose at the U.S. Supreme Court, which thirty years ago held that states may regulate mining but “a state environmental regulation so severe” that it would render mining “commercially impracticable” would be invalid.

PLF’s petition asks the Supreme Court to intervene and resolve this conflict between the California Supreme Court, on the one hand, and the Eighth Circuit, Federal Circuit, and Colorado Supreme Court, on the other. The need for further review is all the more urgent because the California Supreme Court’s decision threatens to inflame already heated conflicts over the uses of federal lands.

Succinct Articulation of Supreme Court nominee Judge Gorsuch's "Original Intent" position

Judge Gorsuch has used his time on the Tenth Circuit to earn a reputation as a writer of verve, clarity, and fidelity to the written text, be it a law under review or the Constitution itself. Upon Justice Scalia’s passing, Gorsuch shared his thoughts on the loss of the lion of the Supreme Court. Some of those comments also articulate the way Gorsuch approaches his role as judge:

"[P]erhaps the great project of Justice Scalia’s career was to remind us of the differences between judges and legislators. To remind us that legislators may appeal to their own moral convictions and to claims about social utility to reshape the law as they think it should be in the future. But that judges should do none of these things in a democratic society. That judges should instead strive (if humanly and so imperfectly) to apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be—not to decide cases based on their own moral convictions or the policy consequences they believe might serve society best."

To paraphrase: judges should not make the law, they should interpret the law. Judge Gorsuch understands his role and for that we should give thanks.

I would be remiss if I did not give an example of his writing that displays the verve and clarity I mentioned earlier. In a case known as Gutierrez Bruziela v. Lynch, Judge Gorsuch wrote a careful concurrence where he took on the judicial doctrine that calls on judges to defer to bureaucrat interpretations of the law. His opening says more in a few words than many lawyers or judges can say in pages:

"There’s an elephant in the room with us today. We have studiously attempted to work our way around it and even left it unremarked. But the fact is Chevron and Brand X permit executive bureaucracies to swallow huge amounts of core judicial and legislative power and concentrate federal power in a way that seems more than a little difficult to square with the Constitution of the framers’ design. Maybe the time has come to face the behemoth."

The ability to turn a phrase like this likely led in part to President Trump’s decision to nominate this good man to the greatest court in the land. Understandably so.

A heated Debate Over Disabled Parking Abuse Rages on a local Facebook page

Dwayne Nystrom posted some pictures and asked a question,

"It usually takes a lot to get my feathers ruffled. I see disabled parking being missed used all the time. So when I came across this today on the way to my son's basketball game I was more than upset, not only one spot misused but all of the parking and accessible access was blocked. Does being a county agency make you exempt from the law? And should county or the driver be fined? Any other driver would."

The question elicited many responses, most being polarized and strongly stated.  On one side was those that thought it a petty issue not worthy of questioning, and on the other was those that were feed-up with what they see as disabled parking abuses.  At the crux of the spirited debate was the question of whether certain agencies are exempt from marked disabled restricted parking.  It was not a question if an emergency vehicle, like police or fire, were using the spot for an emergency related response.  It was a question of wether a non-emergency exception existed for some to use the parking for purposes other than disabled parking.

The thread got heated when some said that the spaces were unused and that no one was inconvenienced.  

One poster even went so far as to write,

"The OP [Original Poster] was NOT impacted, just Butt-hurt. They are not handicapped NOR WERE ANY HANDICAPPED PERSONS IMPACTED EXCEPT THOSE STUDENTS [W]HO NEED THE BUS ACCESSIBLE..."

Janny Kenyon responded,

"the OP is my ex neighbor who was paralyzed in an accident. He has been confined to a wheelchair for several years. So yelling at me is not going to make your statement any less FALSE! Tell me how parking across all the available handicapped spaces made the bus accessible to anyone who was disabled? The bus would have been just as accessible parking across the same number of regular parking spaces while leaving the accessible spaces open so that all those handicapped students you are so worried about could have actually been able to get out their wheelchairs and get unloaded out of their vehicle. The people organizing and performing this service are awesome, they just need to rethink the whole parking issue. The law doesn't allow them to park like that."

“I know Mr. Nystrom and he is one of the nicest people you would ever meet, and is not one to complain frivolously. He is entitled to that parking spot by law. The van could have parked itself in any other area of the parking lot, even just a few spots down to where they weren't parked in the handicapped spots. Apparently they came long before the basketball game started and had the pick of the entire lot in which to park. There was no reason for it, and it made someone's day a little harder for them.”

So the question is who can park in the restricted parking and that is determined by how the law is codified regarding the use.  It turns out the answer ultimately lies in the federal Americans with Disabilities Act (ADA) as of March 15, 2012.  The State of California can ADD to the Federal rules, but cannot be in conflict with them due to the Supremacy Clause (meaning that Fed laws overrules local laws).  And Local municipalities like the incorporated area of Placerville or South Tahoe can also ADD rules but they must also conform to higher levels of law.

Except for emergency use, in California the use of the disabled parking spots are restricted to those with special permits only.  That agencies, such as a 501(c)(3), can apply for such a permit, if they are transporting disabled persons.

 

Controlling Law

 

FINDING OF EMERGENCY OF THE DIVISION OF THE STATE ARCHITECT REGARDING THE CALIFORNIA BUILDING CODE CALIFORNIA CODE OF REGULATIONS, TITLE 24, PART 2 ACCESSIBILITY TO PUBLIC BUILDINGS, PUBLIC ACCOMMODATIONS, COMMERCIAL BUILDINGS AND PUBLICLY FUNDED HOUSING:

-- The U.S. Department of Justice issued the 2010 Americans with Disabilities Act Standards on September 15, 2010.  After March 15, 2012, the 2010 Americans with Disabilities Act Standards became the only option for compliance with the federal requirements.

-- The Division of the State Architect develops accessibility regulations for both government facilities and privately owned public accommodations and commercial facilities.  These accessibility regulations must meet or exceed the requirements of the 2010 Americans with Disabilities Act Standards.

-- Violations of the 2010 Americans with Disabilities Act Standards, even technical ones, are violations of California Civil Code section 54 (c) and may lead to lawsuits over technical violations for fractions of an inch.

Essentially, the federal Act sets the minimum standards for handicap parking spaces and California law or local ordinances can only make the law more restrictive but cannot interfere with the intent of the federal act. In 2013 California law was forced to conform to the standards set by the federal ADA.

 

  • The Department of Justice published revised regulations for Titles II and III of the Americans with Disabilities Act of 1990 "ADA" in the Federal Register on September 15, 2010. These regulations adopted revised, enforceable accessibility standards called the 2010 ADA Standards for Accessible Design "2010 Standards" or "Standards". The 2010 Standards set minimum requirements – both scoping and technical – for newly designed and constructed or altered State and local government facilities, public accommodations, and commercial facilities to be readily accessible to and usable by individuals with disabilities.  State and local government facilities must follow the requirements of the 2010 Standards, including both the Title II regulations at 28 CFR 35.151; and the 2004 ADAAG at 36 CFR part 1191, appendices B and D.

 

VEHICLE CODE - CHAPTER 9 22507.8.  

(a) It is unlawful for any person to park or leave standing any vehicle in a stall or space designated for disabled persons and disabled veterans pursuant to Section 22511.7 or 22511.8 of this code or Section 14679 of the Government Code, unless the vehicle displays either a special identification license plate issued pursuant to Section 5007 or a distinguishing placard issued pursuant to Section 22511.55 or 22511.59.

(b) It is unlawful for any person to obstruct, block, or otherwise bar access to those parking stalls or spaces except as provided in subdivision (a).

(c) It is unlawful for any person to park or leave standing any vehicle, including a vehicle displaying a special identification license plate issued pursuant to Section 5007 or a distinguishing placard issued pursuant to.

Who Can Park in Handicap Restricted Spaces?

 

California law requires that only those who have a handicapped placard or license plate may park in special parking spaces for the disabled. To qualify for one of these, an individual must have impaired mobility that is documented by a healthcare professional.

 

In addition to individuals, agencies can be permitted: “Organizations and agencies involved in the transportation of disabled persons or disabled veterans may apply for a placard for each vehicle used for the purpose of transporting disabled persons or disabled veterans.” VEHICLE CODE - DIVISION 11.22511.55.  (a) (4)

 

Where Do These Restrictions Apply?

 

California Health and Safety Code Section 19955:

(a) The purpose of this part is to insure that public accommodations or facilities constructed in this state with private funds adhere to the provisions of Chapter 7 (commencing with Section 4450) of Division 5 of Title 1 of the Government Code. For the purposes of this part “public accommodation or facilities” means a building, structure, facility, complex, or improved area which is used by the general public and shall include auditoriums, hospitals, theaters, restaurants, hotels, motels, stadiums, and convention centers...

 

This parking lot was at Camerado Middle School and California Government Code Section 4451 includes the location:

(a) ...this chapter shall be limited in its application to all buildings and facilities stated in Section 4450 intended for use by the public, with any reasonable availability to, or usage by, persons with disabilities, including all facilities used for education and instruction...that are constructed in whole or in part by the use of state, county, or municipal funds, or the funds of any political subdivision of the state.

 

Sometimes things happen that make disabled parking temporarily unusable and the code addresses this in California Government Code Section 4451. (f)

Administrative authorities, as designated under Section 4453, may grant exceptions.., but only when it is clearly evident that equivalent facilitation and protection that meets or exceeds the requirements under federal law are thereby secured.

 

Who can do something about it?

-- ARTICLE 1. Authority to Remove Vehicles [22650 - 22711]  ( Article 1 enacted by Stats. 1959, Ch. 3. )
  
22652.  

(a) A peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, or any regularly employed and salaried employee engaged in directing traffic or enforcing parking laws and regulations of a city, county, or jurisdiction of a state agency may remove any vehicle from a stall or space designated for physically disabled persons pursuant to Section 22511.7 or 22511.8, located within the jurisdictional limits in which the officer or employee is authorized to act, if the vehicle is parked in violation of Section 22507.8 and if the police or sheriff’s department or the Department of the California Highway Patrol is notified.

(b) In a privately or publicly owned or operated offstreet parking facility, this section applies only to those stalls and spaces if the posting requirements under subdivisions

(a) and (d) of Section 22511.8 have been complied with and if the stalls or spaces are clearly signed or marked.

Michael Silva Jr. Killed in Solo-Car Crash on Highway 50 was Not Wearing Seatbelt

A 25-year-old Placerville man died Friday morning in a single-vehicle accident on Highway 50 just west of Missouri Flat Road.  The man killed in a car crash on Highway 50 in Placerville on Friday morning wasn’t wearing a seat belt at the time of the crash, the California Highway Patrol reports.

The crash was reported to officers at 7:03 a.m. just west of Missouri Flat Road. Authorities said Silva was driving a 2003 Kia Spectra west about 60 mph when his car “began to rotate on its wheels in a counterclockwise direction,” eventually drifting off to the right shoulder of the highway until it hit a tree.

Bystanders helped Silva, who was unconscious lying across the headrest of the front passenger seat. A Good Samaritan pulled Silva out from the wreckage and performed CPR on him until CHP and El Dorado County Fire Department officials arrived. Unfortunately, Silva succumbed to his injuries. He was later pronounced dead at the scene.

The crash happened amid heavy rain and wet road conditions, the CHP said.

Woman's Car Struck by Brick While Driving ON Green Valley Road

"Just making everyone aware last night on Green Valley going past the community center heading west, someone threw a rock or a brick into my windshield as we were passing each other. I know it was that because CHP told me it happened to another lady on Ponderosa Rd right before me and she had to go to the the ER!! I was luckily unhurt but it could have been way worse. I was able to give them a brief description but it was 10 at night so idk if they'll get the person(s). I guess it's happened to others too in the past few weeks. Everyone please be careful!"

Incident happened on Green Valley Road Thursday.

Jennifer Emery was driving on Green Valley Road near Ponderosa High School Thursday night, when suddenly something came crashing into her windshield from the opposite side of the road.

“I was in shock when it happened. I wasn't sure what it was that hit me,” Emery said. "It scared the living devil out of me."

Luckily, the object hit the passenger side of the windshield.

“It ripped a hole through the windshield and it was raining that night,” Emery said. “That's assault. I mean they very well could have killed me or injured me greatly.”

Emery said glass went everywhere, but she was unharmed.

“I'm very lucky that I didn't get glass in my eyes,” she said. “I panicked, but I was able to stay on the road.”

She pulled over and called the CHP, recalling a raised pickup truck that drove by her just before the impact.

“It was an older-model off-white truck, it had a roof rack like a construction rack and it had a black stripe on the side of it,” Emery said.

Emery believes the item they threw was a brick.

“There was brick dust on the actual window, and you could see where it hit the hood there was a sharp dent where it bounced up,” Emery said.

She said the CHP officer told her she was the second victim that night.

“She had to go to the hospital. I guess she had glass in her neck,” Emery said.

While she waits for her car to be fixed, she hopes someone comes forward with information to help find who did this in her community.

“Everybody knows everybody in this town,” Emery said. “I don’t know what kind of person would think to do something like this.”

Jeffrey Scott Davis, 59, of Placerville Accused of Embezzlement

PLACERVILLE, Calif. — A federal grand jury returned a six-count indictment today against Jeffrey Scott Davis, 59, of Placerville, and Glen Michael Martinka, 67, of Phoenix, Arizona, charging them with conspiracy to commit mail fraud and mail fraud, U.S. Attorney Phillip A. Talbert announced.

According to court documents, between December 2008 and April 2012, Davis and Martinka conspired to embezzle approximately $218,000 from an organic food company by submitting false invoices. Davis was the national sales manager for the company and Martinka was an employee and part owner of a vendor that marketed and sold the company’s products. Davis and Martinka had invoices made that charged the company for services that the vendor did not perform. Davis authorized the payment of the false invoices, and based on these false invoices, the company made checks payable to the vendor and mailed the checks to Martinka in Arizona. Martinka then split the fraudulently obtained money with Davis by mailing checks made payable to Davis.

This case is the product of an investigation by the Federal Bureau of Investigation. Assistant U.S. Attorney Shelley D. Weger is prosecuting the case.

If convicted, Davis and Martinka face a maximum statutory penalty of 20 years in prison and a $250,000 fine. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables. The charges are only allegations; the defendants are presumed innocent until and unless proven guilty beyond a reasonable doubt.
