California’s Cannabis Authorities announces Proposed Regulations for Commercial Cannabis

SACRAMENTO – California’s three state cannabis licensing authorities announced today that proposed emergency licensing regulations for commercial medicinal and adult-use cannabis have been posted online and are available to the public for review.

The Department of Consumer Affairs’ Bureau of Cannabis Control, Department of Public Health’s Manufactured Cannabis Safety Branch, and Department of Food and Agriculture’s CalCannabis Cultivation Licensing Division each developed the new regulations to reflect the law defined in California’s Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA).

On June 27, 2017, the Governor signed MAUCRSA, which creates one regulatory system for both medicinal and adult-use cannabis. Prior to that law’s passage, state licensing authorities had released proposed regulations to govern the implementation of the Medical Cannabis Regulation and Safety Act. The public hearings and comments from a broad cross section of stakeholders that were informing that regulatory process have also been taken into consideration in the drafting of these proposed emergency regulations.

The licensing authorities expect the emergency regulations to be effective in December 2017.

The implementation date for the issuance of the state commercial cannabis licenses remains the same: January 1, 2018. However, California will only be able to license those businesses that are in compliance will all local laws.

SEEKING PROPOSALS TO PROVIDE CHIPPING

Grant funding has been obtained from the United States Forest Service through the Grants Clearing House of the California State Fire Safe Council. The purpose of the grant is to provide residential chipping service to residents on the western slope of El Dorado County.  The grants are intended to assist homeowners in creating defensible space around structures and reduce risk of wildfire. Grant funds totaling $ 182,743 are available for the period January 2018 through July 2019.  Two contractors will be selected and the grant funds will be allocated on geographic location and job assignment.

Small businesses and minority and women owned businesses are encouraged to apply.

Opinion - Christians can Intercede for Better Government

So often we Christians enter the voting booth with this little prayer: “Lord, help me choose the less evil of these candidates.”

But a Biblical scripture accuses us of waiting too long before we pray. Hosea 8:4 says, “They set up kings without My consent; they choose princes without My approval.” We should seek God’s approval not when we vote but when we nominate.

The current political process rewards corruption. Candidates tend to win who spend the most money on their campaigns. And after winning they sponsor legislation that favors their largest contributors.

These big contributors “kick back” even larger contributions to favored candidates who they sponsor for even higher political positions. This process explains how a once Christian nation is currently ruled by corrupt politicians.

To turn this situation around Christians need to obey the whole Bible.  Philippians 2:4 states, “Each of you should look not only to your own interests, but also to the interests of others.” Furthermore, James 2:9 says, “If you show favoritism you sin.”

My weakness as a Christian has been an unwillingness to leave my comfort zone. Unlike our Founding Fathers who concluded that resistance to tyranny was obedience to God, I have enabled the current evil political situation by my silence.

II Chronicles 7:14 says, “If My people, who are called by My name, will humble themselves and pray and seek My face and turn from their evil ways, then will I hear from heaven and forgive their sin and heal their land.”

Our nation needs healing and only obedient Christians can intercede. Shall we unite in intercessory prayer?

The History and Analysis of Proposition 90 in El Dorado County

Late in 2008 while working on the General Plan we were meeting in a local Civil Engineer’s office and it was there that I met a local land use attorney.  I asked him if he knew about Prop 90 and he said no, so I explained it to him and he said, “that will never happen in El Dorado County.”  Following that, in early 2009 our new Supervisor John Knight attended a meeting and I took him aside and asked if he knew about Prop 90.  Again, he did not know either so I explained it to him and he took interest and wanted to help. 

Following that, a group was created to support Prop 90, including the real estate industry and the chambers.  We met with Tim Holcomb and Karl Weiland, from the Assessor’s office to discuss this and they took a very neutral view of what we were doing and did not offer their support.  

I was the interim (2009) Chairman for the El Dorado County Association of Realtors Political Action Committee.  I took on the responsibility of creating the “White Papers” for the presentations to the county  and created the Stop the Drop (dropping property prices) campaign.  Basically the Assessor was required by Proposition 8 to reduce the values of properties as those values fell from 2007-2013.  The problem, of course was that the Prop 13 tax revenues were dropping and they were the major revenue for the county’s General Fund.  El Dorado County was entering deep financial straits.  

With great support from Katie De’Gunther (a local title executive now deceased and missed) rallying folks to the Board Chambers, the Board of Supervisors approved the first participation for a period of two years but after a couple of weeks we were notified that the County Council had made a mistake.  We had to do it all over again and a couple of the members of the board seemed to be stuck on the two year limit.  Prop 90 prevailed again being approved on a 5-0 vote to be put in place for five (5) years.   The reading of the ordinance had to occur and that was approved again by a 5-0 vote.  The Prop 90 Ordinance became effective on February 12, 2010 [sic].  Karl Weiland had inherited the Assessor’s Post from Tim Holcomb and he has done a wonderful job administering this program.  

After the five years had passed the board extended Prop 90 for 18 months.  There was opposition building that did not want seniors coming to El Dorado County and seemed to extend past seniors.  But after the 18 months the Board of Supervisors re-approved Prop 90 for another five years.  (I do not remember the vote.)  And now just one year later the Board voted to rescind the five year approval and cancel Prop 90 altogether.  

Let me speak to the benefit of senior housing that home builders like.  It is the traffic component that is so difficult to get past the California Environmental Quality Act (CEQA).  Of course there is less commute traffic with Senior Housing therefore making the constraint less onerous.  To maintain a Level of Service E (no stop and go on EDC freeways and other roads) becomes very difficult with new family or workforce housing.  Those folks have to commute.  

Has anyone seen the “elephant” in the room yet.  I only saw it a couple of weeks ago and this elephant is HUGE to coin a phrase.  Not through any of this did anyone say “What are the Economic Benefits attending to Prop 90 and what are the Economic Faults coming from Prop 90?  Ok, they did ask the question but they answered with “we can determine the actual tax benefit to the participating seniors (cost to the county) but we cannot determine the benefits to the county.”  Why is this important?  There has never been a Professional Economic Analysis of these two questions as regards Prop 90, only amateur answers.  I have a college degree but not in Economics.  El Dorado County needs to hire an Economist to do a paper on this subject.  Not to reinstate Prop 90 (although that would be nice), but to get a determination of the actual financial impact of any Economic Development Program.  You can bet the City of Sacramento got an Economist’s Report for the building of Golden One Center but, to my knowledge, El Dorado County has never done this.  We cannot allow El Dorado County to wallow in Economic Ignorance!!

Many people have said we no longer need Prop 90 because the financial crisis is over.  Although that crisis was the instigating cause of passing Prop 90 it is not the reason counties or other jurisdictions enter into Economic Development Programs.  Jurisdictions compete with one another for programs that bring money from one area into their target area (again, Golden One Center) to expand the local money supply and economy.  Money supply expands and contracts, pick which one you like.

So, what are the final figures on Prop 90?  Almost 700 seniors and their spouses will have made use of EDC’s Prop 90 program.  These seniors have to be 55 years of age or older.  The detriment of senior housing always comes down to emergency services, particularly ambulance service.  This is provided by the Fire Services within the county.  El Dorado Hills Fire Department says they are losing revenue because of Prop 90 and having to take on the seniors medical emergency problems and expenses.  The department is very organized and could certainly publish the numbers of Prop 90 seniors that have required services.  All they have to do is note the address involved in the emergency (not the recipient of services)  and cross reference it to the county assessor’s office.  Then the emergency services cost analysis would be complete and without violating HIPPA.  These questions would/should be answered in the Professional Economic Analysis.  

The Professional Economic Analysis would also address basic Economic questions and theories.   The theory of the “Gross Multiplication of Money” and the “Velocity of Money.”  These theories are real and need to be addressed along with many others.

El Dorado County Office of Education (EDCOE) Charter Adult Education programs offer instructional programs that touch adults wherever they are in their education or life circumstances. The wide range of educational options is especially beneficial for adult learners who have been confronted with life challenges. Raymond Martin, a current inmate of Placerville Jail, attends classes within the jail and recently celebrated a significant step in his rehabilitation by earning his high school diploma.
 
Martin credits his accomplishment to the staff who have offered him support, including instructor Caroline Earl and Officer Robert Fransen, who checked in with Martin on a weekly basis and encouraged him to improve his circumstances. “Ms. Earl’s compassion for all of the inmates, and the opportunities the officers allowed me as part of this program, motivated me,” announced Martin during his recognition ceremony.
 
Martin is one of the 60 students currently enrolled in the Adult Education program at the Placerville Jail. Approximately 20 percent of the inmate population receive individualized instruction to earn a high school diploma or a General Education Development (GED) certificate. Short-term Career Technical Education Certification and college-level classes are also available through the use of online courses.
 
In addition to serving both the South Lake Tahoe and Placerville Jails, EDCOE’s Charter Adult Education Program provides educational opportunities at various sites throughout the County, including the Community Corrections Center and English as a Second Language programs.
 
Once enrolled in Charter’s Adult Education programs, students are able to pursue an education tailored to meet their unique needs. “We have a very dedicated staff who sincerely care about helping the students reach their goals,” noted Principal Gary Sutherland. “The personal support and the caring partnerships that are forged in the community are a major reason for the success we see across our programs.”
 
A high school diploma is not the end of Martin’s time with Charter Adult Education. He has laid out for himself a series of parenting classes, college courses, and a path to learn a trade to improve his ability to start a career after his release. “I don’t want to live the life I’ve been living. I want to get a job, go to college, and be a better parent. As long as you set your mind to it, you can do it,” Martin encouraged his fellow adult learners.

4 Ways to Keep Pets Safe This Thanksgiving

Thanksgiving is a time when many families and friends gather to share food and spend time together, but the holiday can present some hazards for pets if their owners don’t take simple precautions.

Pet Sitters International (PSI), the world’s leading educational organization for professional pet sitters, advises pet owners to keep in mind their four-legged family members when planning Thanksgiving activities this year.

“Simple holiday traditions, such as hosting a Thanksgiving feast for friends and family, can pose potential problems to pets if not monitored carefully,” said PSI President Patti J. Moran.

PSI offers the following tips for pet owners to keep in mind this Thanksgiving:

1. Don’t let your pets eat the wrong treats. Food is a culprit for some of the most common holiday pet emergencies, so be sure that any guests know which foods are off-limits for your pets. Holiday treats, such as rich, fatty scraps, bones from pork and poultry, alcoholic beverages, chocolate and other sweets and candies, can be harmful or toxic to pets. These foods have been linked to pancreatitis in pets. Signs and symptoms of an inflamed pancreas include vomiting and abdominal pain, and severe pancreatitis requires emergency medical care and treatment. Other dangerous substances for pets include the sugar substitute xylitol, bread dough and onions. If a pet ingests any potentially harmful product, call a veterinarian or a local emergency animal hospital immediately.

2. Keep holiday decorations out of pets’ reach. Will you be decorating your home with cornucopias, pine cones, plants, lights or other festive décor this Thanksgiving? Or will you put up a Christmas tree or other holiday decorations following the Thanksgiving feast? Be sure to keep out of pets’ reach any decorations that could be harmful if chewed on or ingested.

3. Provide a safe space for pets. If your pets are easily frightened or not used to being around a lot of people, Thanksgiving can be an especially stressful time. If your home will be the location for a Thanksgiving celebration, make sure you have a room set aside where your pet can relax with favorite toys and will not be disturbed by guests. And make sure your pet is wearing an identification tag with your name and contact information, in case he or she slips out the door as guests come and go. You may also want to consider microchipping your pet.

4. Don’t just hire a pet lover to watch your pet. If you will be celebrating Thanksgiving away from home—or perhaps will be gone for long hours shopping on Black Friday—your pet could benefit from the services of a professional pet sitter. PSI advises pet owners to only use the services of professional pet sitters.

“Just because someone is a pet lover and has a profile on an online directory—or even on a nationally-publicized site—doesn’t ensure he or she is a qualified pet sitter operating a legitimate business,” said PSI Vice-President Beth Stultz. “In today’s sharing economy anyone can offer their services online, so it’s important for pet owners to take a closer look to ensure they are hiring not just a pet lover, but a pet lover who is also a true pet-care professional.”

Sheriff Offers a Hand Up with HOT Unit

The El Dorado County Sheriff’s Office Homeless Outreach Team (HOT) will be assisting a member of our community this morning by moving him into a home. 

Keith is a Navy Veteran who was seen by one of our Patrol Sergeants picking up trash in the Safeway parking lot of Cameron Park.  When contacted, he told the Sergeant that he was cleaning up trash “because it was the right thing to do”.  

That Sergeant later became the supervisor of our Homeless Outreach Team. During the course of duties, the HOT unit found that Keith had been homeless for four years. 

The HOT unit collaborated with Veteran Affairs, Veterans Services, Only Kindness of Placerville, and other programs to house Keith at Eskaton Lincoln Manor on Mother Lode Drive in Placerville.  Furnishings and other donations have been made to provide Keith with everything necessary to move in.

The move-in event is planned for Monday, November 20, 2017, at 0900 hours, at 6600 Mother Lode Drive in Placerville.

Placerville School District takes a Holistic approach to Campus Safety

Two schools take a holistic approach to campus safety with a uniquely integrated communications solutions from Avaya and Valcom.

A keen focus on safety has led two schools on opposite sides of the county to develop best practices supported by an integrated, multi-faceted communications solution from Avaya and Valcom, an Avaya DevConnect technology partner. Placerville Union School District in Northern California and Gottesman RTW Academy in N.J. may be miles apart, but share a similar approach to making their Smart Schools safer and smarter, speeding response times and improving outcomes should a crisis occurs.

Placerville Union School District has two elementary schools and one middle school, with about 150 staff members between them. The district was compelled to streamline the emergency response process, realizing that doing so meant technology had to play a vital role. With Avaya and Valcom, staff across the district can:

- Flip a switch under any office desk to trigger alert announcements and automated calls to emergency personnel;

- Activate the lockdown bell from any classroom phone, and in an emergency, play an automated message from the superintendent;

- Know when a 9-1-1 call is placed anywhere in the district via an automated digital message displayed on an LED sign in every office.

In N.J., at a smaller institution but one no less focused on campus safety, Gottesman RTW Academy looked to streamline its entire communications system with the construction of a new facility. Like the Placerville Union School District, Gottesman integrated its Avaya IP Office Platform with Valcom's Emergency Mass Communications and Live Paging System. The combined solution delivers efficiency, reduces resource needs and increases communication among students and staff at the school and with the larger community. The system is capable of reaching 100 percent of the school population with emergency notifications made from any classroom or office.

Heavenly Village Wine Walk – Thursday November 30th 5pm to 8pm

Attention South Lake Tahoe and Visiting Wine Lovers!

CAMINO, CA – November 22, 2017 – Seven wineries with tasting rooms located along Carson Road in Camino in central El Dorado County have partnered with the Shops at Heavenly Village to bring back the popular Heavenly Village Wine Walks to South Lake Tahoe.  The first date for this fun event is set for November 30, 2017.  Wine glasses will be sold at the entrances to Heavenly Village starting at 5pm.  The event continues until 8pm.  There will be ten wine sampling stations along with a number of restaurants providing food and beverages samples for attendees.  Proceeds from the $20 event donation will be sent to support North Bay Fire Relief charities helping victims of the Napa and Sonoma Fires.  

“We are very pleased to see the long-anticipated return of this event”, said Dreu Murin, promotions director for the Shops at Heavenly Village. “Heavenly Village is a major showpiece for our community and we are excited to feature local wineries and raise funds for the tragic fires that affected Napa and Sonoma in October’.  

The Carson Road Wineries were organized in 2008 to concept, create and host fun and innovative events to showcase the great wines and legendary hospitality in the Camino region along upper Carson Road. For this event, each sampling station will have three featured wines from the Carson Road Wineries. “We are grateful to have our wines featured at these Wine Walks”, said Mike Owen, founder of Crystal Basin Cellars. “We are the closest winery region to South Lake Tahoe and this is a great opportunity to showcase a range of award-winning wines from our family-owned wineries and to attract visitors who drive right by our tasting rooms”.

The participating wineries for the Heavenly Village Wine Walk at are Bumgarner Winery, Via Romano, Mastroserio Winery, Findleton Estate & Winery, Nello Olivo Winery, Illuminare Winery and Crystal Basin Cellars.  Wine Walks are scheduled for 2018 will be held on the last Thursdays of February, May, August and November.

Opioids could kill nearly 500,000 in U.S. in next decade!

According to the CDC, the United States is in the midst of an opioid overdose epidemic.

Opioids (including prescription opioids, heroin, and fentanyl) killed more than 33,000 people in 2015, more than any year on record. Nearly half of all opioid overdose deaths involve a prescription opioid.  Women are more likely to have chronic pain, be prescribed prescription pain relievers, be given higher doses, and use them for longer time periods than men. Women may become dependent on prescription pain relievers more quickly than men.

Opinion - California Lawmakers Have Enabled Culture of Sexual Harassment

The issue of sexual harassment has jumped to the forefront of public discourse in a relatively short period of time, with revelations about alleged sexual misconduct ranging from the inappropriate to the illegal.

The accusations have flown from the studios of Hollywood to the halls of Congress, from film executive Harvey Weinstein to longtime television news personality Charlie Rose; from National Public Radio news chief Michael Oreskes to Senator Al Franken (D-MN); from Congressman John Conyers (D-MI) to Republican Senate candidate Roy Moore.

With each passing day, more stories are coming out, and the California State Capitol, while a relative side-show compared to some of the more newsworthy persons dominating national politics, has been turned on its head.

In mid-October, a bipartisan group of more than 140 women - lawmakers, lobbyists and consultants - signed a letter calling attention to pervasive sexual harassment in California politics. Since that time, two California state legislators - Senator Tony Mendoza (D-Artesia) and Assemblyman Raul Bocanegra (D-Pacoima) - have been embroiled in scandal, with multiple women coming forward making scathing accusations about each.

In the case of the former, Mendoza has denied allegations. Senate President Kevin de Leon (D-Los Angeles) recently suspended Mendoza's chairmanship of the powerful State Senate Banking Committee, pending further investigation. With regards to Bocanegra, he has admitted wrongdoing. Facing increasing scrutiny, he has announced that he will be resigning from the legislature - albeit on an arbitrary date he picked in September of next year. Assembly Speaker Rendon (D-South Gate) has removed him from his leadership position and his committee assignments.

I won't take the time in this column to detail the specific allegations against both, but suffice it to say they paint an alarming picture of a culture in the State Capitol that has been permissive of such bad behavior, or worse. One can assume that this will only snowball in the coming weeks and months, as more revelations occur. (For example, de Leon, it has been revealed, was roommates in Sacramento with Mendoza, moving out just days ago - which is significant in that accusations against Mendoza include inappropriate activities taking place in his residence).

The California legislature, however, has taken steps to make sure that the permissive culture of sexual harassment would thrive - embracing the idea that legislators not only make the law, but are above the law.

For decades, the only way that someone who was harassed or abused could bring it to anyone's attention would have been to go to legislative leadership - never mind the obvious conflict of interest there. What legislative remedies have been pursued by some have been bottled up in committees. A great example is legislation pursued for years in a row by Assemblywoman Melissa Melendez (R-Temecula) to protect whistleblowers who report unethical or inappropriate behavior. It has never made it to the Governor's desk.  It should come as no surprise that laws were passed giving all other state government employees whistleblower protection, but the legislature was exempt.

Speaking of exemptions, the Los Angeles Times put in a request for details on any formal investigations of allegations of sexual abuse on the legislature. It received a brief summary indicating that in the last decade there have been 31 such investigations - 15 in the State Senate and 16 in the State Assembly - but the legislature has refused to provide any more detail, and is not obliged to provide any more detail.  That is because the California legislature exempted itself from the Public Records Act, which applies to the rest of state government.

There are some actions that the governor and legislature can take to try to regain some credibility here, and try to end Sacramento's toxic culture. And while Democrats in the Capitol control all of the levers of state government - and are the only ones that can create laws in a partisan fashion - Republicans have the bully pulpit and can publicly call for Governor Jerry Brown to call a special legislative session to deal with this issue immediately.  In the special session, the legislature should send several bills to Brown for his signature, including:

  • -- A bill to establish that a law enforcement agency (perhaps the California Highway Patrol) has jurisdiction over investigations of allegations of sexual harassment in the Capitol. The idea is to put someone in charge of such investigations who is not beholden to legislators.
  •  
  • -- The Melendez whistleblower protection bill that has been shoved into a legislative drawer for years.
  •  
  • -- A bill to make sure that the legislature is subject to the California Public Records Act, like every other part of state government.

 

Finally, there should be a formal investigation into de Leon's friendship with his now-former roommate, Senator Mendoza. Perhaps de Leon's position should even be suspended pending the outcome.

The idea that de Leon, as Chairman of the Rules Committee (made up of Democrats and Republicans who are his hand-picked choices), is going to clean up the Senate's act lacks credulity.
