Colorado governor offers advice to California on taxing legal marijuana

California took a major step last November when voters approved an initiative legalizing recreational marijuana, but there is still much work to be done before licensed businesses can begin selling weed to customers next year.

One of the biggest challenges facing state regulators is how to enforce a cultivation tax on growers and a 15 percent sales tax that were included in the ballot measure.

California tax officials have complained for years about the difficulty of collecting revenue from the medical marijuana industry, which largely pays taxes in cash because few financial institutions will take its money. And the exponentially larger legal weed market will create new demands on a program tracing the plant through every step of the distribution chain to ensure that no untaxed product is sold.

Are Millennial Employees Different? El Dorado Hills Travel Agent Speaks Out, Part One

With more Millennials entering into careers in travel, travel agency owners and executives are adapting to some of the unique expectations and needs of this growing generation.

Communication styles, work environments and career expectations are areas of focus, and agency owners are managing training programs and talent development programs to engage and retain Millennials.

“The unique characteristics of Millennials demand a different strategic approach to the recruitment and retention of employees,” PricewaterhouseCoopers International found in a report entitled Millennials at Work: Reshaping the Workplace. “Millennials are looking for more in life than ‘just a job’ or a steady climb up the corporate ranks. They want to do something that feels worthwhile.”

“I’ve always said I would rather get paid less and enjoy going to work every day than being paid more and hating every minute I’m on the clock,” said one Millennial travel agent, Emily Bertsch, team leader and head of office sales at VIP Vacations in Bethlehem, PA. “Being able to travel and see the world is way more satisfying and is worth more than any dollar I could get paid.”

“They like to have an impact and feel valued,” said Jennifer Doncsecz, president, VIP Vacations, where the oldest employee outside of Doncsecz is 32 years old.

At Coastline Travel Advisors in El Dorado Hills, CA, president Jay Johnson made a conscious choice to start targeting his recruiting to Millennials about 10 years ago. Today, about 50% of his staff are in that age group, and he finds them to be well motivated and perfect for a career in travel.

“I’m hiring people who come right out of college, and they are very bright. They've done a lot of traveling growing up. They come to us because they have traveled and they are passionate about travel.”

“The biggest draw for Millennials (52%) is the opportunity for progression, PwC found, followed by competitive wages (44%). About one in three said they are attracted to employers who offer excellent training and development programs.

More than half (56%) of respondents said “they felt they could rise to the top with their current employer,” so supervisors and owners “should be careful to manage expectations and identify and reward the young talent that they are keen to keep and develop.”

“There are challenges that come with hiring Millennials,” Johnson said. “The biggest thing is retention. They're looking to get ahead. Training that helps them go on and do other things helps a lot.”

One-on-one feedback and on-the-job training are first choices
“Millennials expect to keep on learning as they enter the workplace,” PwC said. “In an ideal world, they would like to see their boss as a coach who supports them in their personal development – but also generally prefer to learn by doing rather than by being told what to do. Mentoring programs can be particularly effective and also help to relieve tensions between generations.”

Slightly more than half (51%) of the PwC respondents said “feedback should be given very frequently or continually on the job. The companies that are most successful at managing Millennials are those that understand the importance of setting clear targets and providing regular and structured feedback.”

PwC also advises business executives to “consider allocating projects to talented Millennials which fall outside their day job. Let them connect, collaborate, build their networks – and most of all innovate.”

Johnson tries to create new positions when he sees a millennial employee is ready for a change and jump up in responsibility. “You can see when they are looking for a new challenge. It makes me work harder to be creative. But it's helped us too, having that challenge, because we do things like explore new lines of business, or maybe open a location where a millennial can be the manager.”

In one instance, Johnson created a whole new B2B business, working with tour operators from outside of the United States who want to develop their brands here.

Opinion - Setting the Record Straight on Recent Presidential Protests

Today, thousands of people assembled in streets around the world to protest the presidency of Donald J. Trump for the fourth straight day in a row.

While the vast majority of the protests have been peaceful, spurts of violence have drawn the attention of the media. Reports of protesters throwing rocks and bottles at police in Santa Ana, stories of property destruction in Oregon, and a video of a physical attack against a Trump supporter in Chicago are a few examples of the recorded violent reactions to Trump’s election.

President-elect Trump responded to the demonstrations by tweeting: "Just had a very open and successful presidential election. Now professional protesters, incited by the media, are protesting. Very unfair!"

Trump’s supporters also perceive these protests as “unfair” because they claim there were no riots following Obama’s election.

According to conservatives on social media, “Republicans have jobs and responsibilities” and therefore couldn’t engage in civil disobedience to voice their discontent with the 2008 and 2012 elections. With this perception of the Obama elections and subsequent claims of “ Republican acceptance,” Trump supporters are now demanding the same “fairness” for Donald J. Trump’s presidency, “We sat through do nothing politics for 8 years, the least they can do is go shut up and sit in the corner for 8 themselves,” on Trump supporter explained.

However, these perceptions do not reflect what actually followed the election of our country’s first black president, much less the difference between why people are protesting Donald J. Trump’s presidency as compared to Barack Obama’s presidency.

Obama’s election in 2008 was preceded and followed by violent attacks and property destruction targeted against minorities.

Kaylon Johnson, an African American campaign worker for Obama, was physically assaulted for wearing an Obama T-shirt in Louisiana following the 2008 election. The three white male attackers shouted “Fuck Obama!” and “Nigger president!” as they broke Johnson’s nose and fractured his eye-socket, requiring surgery.

More frequently, Obama’s presidency was marked by effigies of our first black president hanging from nooses across the country, for example in Kentucky, Washington State, and Maine, or being burned around the world. What Trump supporters fail to remember is that following Obama’s election, property was destroyed across the country, for example in Pennsylvania, Texas, and North Carolina, and a predominately black church was torched in Massachusetts.

In 2008, anti-Obama protesters lashed out against minorities because of their discontentment with a black man being voted into the office of president for the first time in our nation’s history. Conversely, in 2016, anti-Trump protesters are holding mostly peaceful demonstrations because of their discontentment with a man, who has ostracized minorities, being voted into the office of president.

And while anti-Trump protesters have engaged in mostly peaceful demonstrations against the president-elect, pro-Trump supporters have been responsible for a wave of attacks against Muslims, Latinos, blacks, and the LGBT community.

According to Mark Potok, senior fellow at the Southern Poverty Law Center civil rights group, there haven’t been “such a rash of hate crimes in the United States since Barack Obama was elected America’s first black president in 2008.” Muslim women are reporting having their hijabs ripped from their heads, while immigrant children are being bullied. Trump’s name and slogan, “Make America Great Again,” are being found alongside swastikas and anti-minority messages in graffiti around the nation.

Ultimately, demonstrators are not protesting Trump because he is Republican. They aren’t protesting him because he is a white male. These protests are because of the bigotry his campaign has emboldened and the fear of discrimination his presidency has the capacity to perpetuate.

Opinion - Yale and Harvard Law Deans Pull No Punches in Op-Ed on Trump

The deans of Yale Law School and Harvard Law School have joined the growing chorus of lawyers publicly condemning President Donald Trump’s attacks on the judiciary.

In a blistering op-ed in The Boston Globe on Friday, Harvard’s Martha Minow and Yale’s Robert Post wrote that Trump’s Twitter-delivered insults against the federal judges who stayed his controversial travel ban risk making the president “an enemy of the law and the Constitution.”

“By questioning the legitimacy and authority of judges, Trump seems perilously close to characterizing the law as simply one more enemy to be smashed into submission,” the deans wrote. “At risk are the legal practices and protections that guard our freedom and our safety from the mob violence that destroyed democracies in the 1930s.”

Trump called U.S. District Court Judge James Robart, who initially stayed the travel ban, a “so-called judge” on Twitter. He then went after the appellate panel for leaving Robart’s order in place, calling their ruling “disgraceful,” among other comments. Last year, Trump accused the judge hearing a lawsuit over his Trump University of bias due to the jurist’s Mexican heritage.

Post said in an interview Monday that he is generally reluctant to weigh in on matters outside the scope of the law school, but Trump’s hostility to the courts demanded a response. “I felt that what’s going on here was really an attack on the rule of law,” Post said. “It’s the mission of the school to preserve and sustain the rule of law, so it came under my obligation as a steward of the institution.”

Post and Minow aren’t the only lawyers weighing in. The legal profession has been vocal in its criticism of Trump’s repeated disparagement of judges.

Last week, American Bar Association president Linda Klein lambasted Trump’s attack on Robart in a fiery speech delivered during the organization’s midyear meeting in Miami. “There are no ‘so-called’ judges in America,” Klein said.

“There are simply judges, fair and impartial. And we must keep it that way.”

Even Trump’s own U.S. Supreme Court nominee, Neil Gorsuch, said the president’s tweets about the judges’ handling the travel ban challenge were “disheartening” and “demoralizing.” The Trump administration later asserted that Gorsuch wasn’t specifically referring to the ban.

Post said he and Minow were careful to avoid commenting on the constitutionality of Trump’s travel ban. “I’m speaking out on attacking judges personally,” he said. “I’m speaking out when [Trump] said, ‘Any high school student could have decided this. You don’t need judges. You don’t need professionals. You don’t need legal expertise because it’s all politics.’”

Minow echoed Post’s sentiments in a statement issued through a law school spokeswoman. “Dean Post and I were writing as scholars, lawyers and teachers, and our roles leading two of the nation’s top law schools compelled us to speak out,” she wrote.

Both Minow and Post are in their final semesters leading their respective law schools. Each has said they will step down as dean and return to teaching next academic year.

The last time the two deans paired up on an op-ed was in 2014, in the wake of several high-profile killings of black men by white police. “As we mourn the deaths of Eric Garner and Michael Brown, let us remember that the real grand jury is all of us,” they wrote. “We must constantly ask how we can narrow the gaping distance between our legal ideals and the practices we countenance.”

Similarly, the deans called for everyone to stand up against Trump’s attacks on the courts in their latest op-ed.

“If we are to keep the rule of law, it must not be a partisan question; it must not be the concern simply of lawyers. We must all defend it, passionately and whole-heartedly,” they wrote. “Without the rule of law, we may have a “so-called” president who in fact has become a tyrant. Fundamentally, this moment is not about Trump. It is about all of us.”

Highway 50 OPEN but Forecasted Heavy Rains Worrisome

Caltrans reported that Highway 50 had reopened from Pollock Pines to Strawberry at 10:30 pm. Tuesday after multiple mudslides had closed in both directions between Pollock Pines and Strawberry in El Dorado County for days.

"Highway 50 will remain 'closed indefinitely' as crews slog their way through clearing three major mudslides across a 12-mile stretch, as well as several smaller, active mudslides" according to Caltrans a few days ago.  

The first mudslide occurred near Sand Flat around 5:30 p.m. Friday, covering all four lanes of traffic, according to Caltrans.

A second mudslide between Whitehall and Kyburz occurred Saturday afternoon. Though it is smaller than the initial mudslide, crews are facing more difficulty clearing it because the slope is steep, Caltrans said.

The third mudslide also occurred Saturday afternoon two miles east of Kyburz, Caltrans said. That one is about 400 feet long.

“The slope is a mix of sand and boulders with little cohesion,” Caltrans said in a release.

Highway 50 at Cave Rock has reopened also after the slide there was cleaned up.

While some welcomed the re-opening of the Highway, they did so with some hesitation as they asked, "but for how long" as heavy rain is forecast for late tonight and most of the day on Thursday.

Disaster Declaration Form for Private Parties to Report Losses from Storms

Due to the recent series of storms and the Governor’s request for a Presidential Major Disaster Declaration for the damage, the El Dorado County Sheriff’s Office of Emergency Services is making available an Individual Damage Assessment form. 

The form allows private parties (e.g. individuals, HOA’s, etc.) to track their damage from the storms and it could assist in receiving a Presidential Major Disaster Declaration. However, completing the form does not guarantee any reimbursement for losses due to the storms. It is simply a very thorough method of tracking damage and reporting it to the State and Federal Government. The Individual Damage Assessment form is located on the County’s website under the “Current Topics” icon and is labeled “Private Party Damage Assessment Form”. Click on the link and you can fill out the form electronically or print out the form and complete it by hand.

Please complete the form to the best of your ability and email electronic copies or scanned copies to crawfordt@edso.org or you can drop your form off at the Sheriff’s Office at 300 Fair Lane, Placerville, CA.  If you have any questions about the form please call Deputy Todd Crawford at 530-621-7660.

Without Proper Funding, Road Maintenance in El Dorado County at Standstill

EL DORADO COUNTY -- All the storms we've seen this winter have left their impact on roads in the foothills. In southern El Dorado County, many are complaining little's being done to repair potholes and mudslides. But the county said the money's just not there.
Roads have potholes, mudslides and even sinkholes. Things are so bad on some southern area roads that they been shut down.

"A lot of road infrastructure issues that not only happen during the rain but then been kind of building up before that," said Mark Almer, who lives in Grizzly Flats, and is one of about fifty people who attended a county town hall at Mountain Creek Middle School to discuss what's being done. "A lot of people are inconvenienced because a couple of main roads are shut down and that's their way to get to grocery stores and things like that. We need to make sure that these things get fixed, especially before wildfire season hits and, God forbid, if we ever had to evacuate."

"We're planning on doing some road maintenance but unfortunately, due to the funding and our budget, it did not happen," said District 2 County Supervisor Shiva Frentzen, adding the county is trying to lobby funds from the state and federal government. "Unfortunately, things are not moving quickly."

In the meantime ambulances, fire crews and police are having to take the long way around. But the county's Office of Emergency Services is sending out updates on their digital mapping systems.

"Say one of our local roads gets a slide on it, our Department of Transportation, or us, or Highway Patrol gets out there, we confirm the slides there; we can instantly go to the map, mark the road and it shows there's something going on on that road," said El Dorado County Sheriff Lt. Jim Byers, who runs the County's Office of Emergency Services.

Byers said the county was included on President Trump's California Disaster Declaration issued Tuesday to help communities affected by flooding and mudslides. But it's unclear how long that money will take to be used on projects such as fixing these southern roads.

Bill would provide Independent Oversight of Mental Health Services in El Dorado County

This week Assemblyman Kevin Kiley (R-Roseville) introduced a bill to assure that the $2 billion allocated each year from Proposition 63 is serving the mental health needs of Californians.

The bill would provide independent oversight of programs funded by the Mental Health Services Act, passed as Proposition 63 in 2004. The Act allocates roughly $2 billion each year for the provision of county mental health programs. Though counties are required to report on program performance, no state agency reviews reported data to determine compliance or measure outcomes, with the State Auditor and Little Hoover Commission estimating that up to $17 billion in spending has lacked appropriate oversight.

"The absence of oversight has clear consequences: California leads the way in funding for mental healthcare, yet almost half of the 2.2 million Californians who live with mental illness are not receiving the treatment they need," Kiley said. "More effective oversight will engender accountability, and it will ensure that the information counties collect is put to use improving the performance and impact of mental health programs."

Assembly Bill 488 would create an independent accountability office, led by an Inspector General, to investigate, monitor, and track the provision of mental health funding.

Community Collaboration Inables South Lake Tahoe Warm Room

Less than two years ago, I had an amazing opportunity to learn about an idea in our community. This nascent concept was to ensure human dignity for our vulnerable neighbors with insufficient housing.

This conversation soon grew and reached over a hundred individuals on our South Shore community as the Tahoe Coalition for the Homeless (TCH) and its Warm Room project were born. Then, the newly formed board understood what I learned about in that first conversation: With partners and with energy we could make a difference in our community.

This first goal of ensuring human dignity soon grew beyond this first-level, yet imperative, objective to include providing safety and services and even to work toward longer term and lasting solutions. As the coalition formed and brought together people from different walks of life, there was a growing sense of community. It has been through relationships formed between different faith groups, among people from different professional and occupational circles and by linking the private concerned citizens together with the public entities at the city and the county that success has been achieved.

As a member of the advisory council of the Tahoe Coalition for the Homeless, I was invited to a conversation with Councilmember Wendy David, Police Chief Brian Uhler and TCH board member Nicole Zaborsky. Learning even more about the relationships that have been created along the way, I heard first-hand about the shared outcomes the city holds together with the coalition.

It is because of this commonality that partnership is not only possible, but continues to be effective. Hearing both Chief Uhler and Councilmember David express a clear concern for everyone’s human dignity, that the coalition, together with the city, the county and the police department (and others) can work to ensure better safety and access to services was up-lifting.

This shared vision of a community working together to provide for people who are homeless, in need of quality services and most of all a sense of connection, continues to make the Warm Room project a great success. There is no doubt that challenges exist on a daily basis. Yet, through the partnerships, the shared outcomes and a bit of hope, so much is still possible.

I am grateful to continue to be a part of the TCH’s work and the Warm Room project. I also want to offer thanks to Chief Uhler and the City Council for their constant support. The South Lake Tahoe Police Department’s partnership has been made possible by the many key players at the department. From the officers to the office staff, from the dispatchers to those keeping records and all serving and ensuring the public safety in our community, we are grateful for their shared commitment.

As a rabbi in this community, I am reminded of the prophetic call from the Book of Isaiah (58:7), that we are charged to bring shelter to the cast down poor. As we embrace this year, 2017, and the second year of the Warm Room project, it is my sincere hope that through this work our entire community is strengthened in part by knowing the innumerable ways we can all work together. Working as public servants, as private citizens, as local businesses and beyond, toward our shared outcomes impacts our entire community positively. Just as that conversation less than two years ago became a reality, we all know that it only takes this the first step!

As a member of the advisory council, I would like to also extend the invitation to the whole community at our open house event honoring Councilmember David on Wednesday, Feb. 22, from 4 to 6 p.m. The entire community is invited to join us at our Warm Room, located at 2179 Lake Tahoe Blvd. Together we can all make a difference in helping members of our community who need our support and continue building meaningful and lasting partnerships.

Katie Dobler - 1983-2017

El Dorado County Deputy District Attorney, Katie Dobler, passed away early Monday morning, February 13, 2017. She was 35 years old. 

The People of the State of California, the residents of El Dorado County, and the El Dorado County District Attorney's Office have lost a passionate and relentless advocate for justice. Katie's family, friends, and coworkers have lost a loving daughter, sister, and friend who was fiercely loyal and devoted.

Katie had an absolute love for justice, unwavering patriotism, and wholehearted faith and support of the men and women in the military and law enforcement communities. Katie passed while doing what she loved to do - passionately fighting for justice as a prosecutor and a patriot.

Katie attended El Dorado High School, and UC Davis for both undergrad and law school. She started working for the District Attorney's Office in 2011. Katie enjoyed watching the Oakland Raiders, was a military brat that bled red white and blue, and loved this country and all that it stands for. Her love of country grew early in life seeing her dad in the Air Force, working on SR-71 Blackbirds at Beale Air Force Base.

El Dorado County District Attorney Vern Pierson noted, "Although her life was cut far too short, Katie had a significant impact on the victims she fought for and lives she touched. She will be missed."

Services for Katie will be held Tuesday February 21, 11 a.m. at the Green Valley Mortuary at 3004 Alexandrite Drive in Rescue. A private interment is planned.

Kyle Larson Returns to Placerville Speedway in Short Track Outlaw Showdown

PLACERVILLE, CA – For local dirt track racing sprint car enthusiast things just got a little sweeter.  Elk Grove’s Kyle Larson confirmed that he will be racing at the third annual Brad Sweet’s Placerville Short Track Outlaw Showdown presented by Riebes Auto parts held Wednesday night, March 29th, featuring the greatest show on dirt The World of Outlaws Craftsman® Sprint Car Series.  Larson is returning to the track that produced his first career sprint car win.  “I am excited to race in front of a lot familiar fans at Placerville Speedway and to also get the chance to compete against the best sprint car drivers in the world,” said Larson.   

“Last year we had Kyle scheduled to race with us on that Wednesday night but unfortunately he wasn’t able too because of an injury he sustained in the NASCAR series the weekend prior to our event,” said Sweet.  “I know how disappointed he was last year in not racing against us but I also know how much he is looking forward to competing at this year’s race.” 

Reserved tickets are going fast but fans are still able to purchase their tickets for Brad Sweet’s Placerville Short Track Outlaw Showdown presented by Riebes Auto Parts by following this online link at https://dirtcar.ticketforce.com/ordertickets.asp?p=741&backurl=default.asp  Reserved tickets are $45 per seat.  Fans can purchase pit passes / general admission seating on the day of the event but those seats are all first come first serve.  Tickets and will call booth will open at 2 PM.  Pit gate opens at 2 PM.  Grandstands open at 4 PM with sprint car qualifying slated to begin at 6:30 PM.

An overabundance of sprint car stars will be joining Larson at Brad Sweet’s Placerville Short Track Outlaw Showdown presented by Riebes Auto Parts.  Leading the charge is Fargo, North Dakota’s Donny Schatz.  The eight-time World of Outlaws champion and inaugural winner of the Sweet race at Placerville drives the Tony Stewart Racing/Arctic Cat/Ford Performance/No. 15.  Last year’s winner Jason Johnson of Eunice, LA is set to get his Fischer Body Shop/Waco Metal No. 41 back into victory lane to collect the $10,000 payday.  Both Schatz and Johnson went on to win sprint car racing’s biggest prize, the Knoxville Nationals, in the same year they won the Placerville Short Track Showdown. 

Kasey Kahne Racing teammates Daryn Pittman of Owasso, Oklahoma, driving the Great Clips No. 9 and the event organizer Brad Sweet of Grass Valley, driving the Napa Auto Parts No. 49 are two of the favorites heading into this race.  Other top drivers with the World of Outlaws include Shane Stewart, of Bixby, OK, who drives the Larson/Marks racing No. 2, the Brownsburg Bullet Joey Saldana in the Elk Grove Ford/Roth Investments No. 17 for the newly-formed Stenhouse Jr.-Wood Racing team and another local favorite Paul McMahan of Nashville, TN by way of Elk Grove, CA driving the Destiny Motorsports No. 4.

Sweet has once again booked the popular USAC Western States Midgets as his companion division with the World of Outlaws.  “I felt the midgets put on a great show and it gives the fans a nice mix between the winged sprint cars and non-wing midgets,” said Sweet.

On March 29th, it will mark Sweet’s third time being a promoter.  His own career started at local tracks like Placerville Speedway.  “It feels good to be a part of something local,” said Sweet.  “The outpouring of support from the fans, sponsors and teams has been overwhelming.”  Even though Sweet will be wearing the promoter hat don’t forget that he is also a fierce competitor behind the wheel.  Sweet is a 21-time winner in the WoO Series and earned the 2014 Rookie of the Year honors.  He has won prestigious races such as the Kings Royal at Eldora (2013), the Short Track Nationals (2010) and Belleville Nationals (2008). He also has six career top-10 finishes in the NASCAR XFinity Series driving for JR Motorsports and Turner Motorsports.

The traveling Outlaws will have their hands full with a talented field of local drivers led by Rutherford’s Rico Abreu.  The popular Northern California driver has beat the Outlaws before and will get another chance at the Placerville Short Track Showdown.  Reigning King of the West champion Kyle Hirst of Paradise is back with Roth Motorsports No. 83.  Auburn’s Andy Forsberg is a multi-time champion at Placerville Speedway and will look to put the A & A Stepping Stone No. 92 in victory lane.  Campbell’s Bud Kaeding, Hanford’s DJ Netto and Cory Eliason of Kingsburg are other California based driver’s hopeful of beating the World of Outlaws at Brad Sweet’s Placerville Short Track Outlaw Showdown presented by Riebes Auto parts.

COMMENTARY - The Truth About Sanctuary Cities and Crime Rates

If restricting local law enforcement from cooperating with Immigration and Customs Enforcement (ICE) detainer requests is supposed to make communities safer, as some immigration advocates and law enforcement officials suggest, I’d like to hear them reconcile their beliefs with the actions of Texas’ Travis County Sheriff Sally Hernandez.

Hernandez, sworn in as the newly elected head of the Travis County Sheriff’s Department last month, almost immediately adopted an anti-cooperation policy prohibiting her department from honoring nearly all ICE detainer requests.

“The public must be confident that local law enforcement is focused on local public safety, not on federal immigration enforcement,” Hernandez said.

Detainer requests are notices sent by ICE to local jurisdictions informing them of its desire to take physical custody of an individual in local custody.

The sheriff’s new policy stipulated that only four exempted crimes—murder, capital murder, aggravated sexual assault, and human trafficking—would be grounds for her department to honor an ICE detainer.

Unfortunately for the alleged victim of Hugo Javier Gallardo-Gonzalez and the community at large, accusations of repeatedly sexually abusing a child did not meet the criminal standard for ICE cooperation set by the sheriff.

Gallardo-Gonzalez was arrested this past Sunday, accused of sexually assaulting his girlfriend’s young daughter beginning in 2014. The abuse is alleged to have continued for over a year.

Immigration and Customs Enforcement submitted a detainer request to the Travis County Sheriff’s Office in order to take custody of Gallardo-Gonzalez, but their request was denied.

Gallardo-Gonzalez subsequently made bail the next day and is now waiting to be released once outfitted with a GPS monitor.

The decision by Hernandez to deny the ICE detainer request was reckless and borders on malfeasance.

Whose well-being is served by the decision to dismiss this ICE detainer request and release into the public an individual accused of a particularly heinous crime? Is the public safer as a result? Is the community of illegal individuals safer?

The answers to those questions seem clear enough. No one, save perhaps the accused man, is better off for the decision by the sheriff to deny assistance to ICE.

But this reality doesn’t conform to the narrative repeated by many that suggest law enforcement cooperation with federal immigration authorities hurts public safety and erodes police and community relations.

Mayor Javier Gonzales of Santa Fe, New Mexico, argued only months ago that sanctuary cities have no impact on crime, stating, “Study after study [has] shown that sanctuary cities do not lead to an increase in crime because of the presence of people that are undocumented.”

But a 2014 draft study conducted by ICE doesn’t support the mayor’s notion that sanctuary cities have no impact on crime.

The study found that during the observation time frame (January 2014 to August 2014), 8,145 individuals were released from jail after arrest due to their respective jurisdictions declining an immigration detainer request from ICE.

Of the 8,145 individuals released, 1,867 were subsequently re-arrested a total of 4,298 times and accumulated a staggering 7,491 charges.

So much for the argument that sanctuary cities have no impact on crime.

The notion that local law enforcement cooperation with ICE will somehow also destroy police and community relations—specifically relations between the police and communities of illegal immigrants—is tenuous.

No community of decent people—citizens, illegal immigrants, or otherwise—wants to live in a society beset by violence and social dysfunction. Stripping local law enforcement of the ability to merely cooperate with their federal counterparts on issues as plain as the removal of a dangerous criminal jeopardizes the safety of all law-abiding individuals.

Hernandez and her refusal to cooperate with ICE on the removal of an individual accused of sexual assault against a child demonstrates the absurdity of those devoted to a dogmatic faith in sanctuary cities. Clarity and perspective should rule the day, especially when public safety is at stake.

* An incoming strong storm system will bring a period of excessive  rainfall to northern California. The combination of saturated  ground, heavy rain, and snow melt will result in large amounts  of runoff into rivers and streams.

* Significant rises in rivers and streams draining from the  mountains can be expected beginning Sunday night. Elsewhere,  flooding of poor drainage areas and flood prone creeks and streams  will be possible across the Sacramento and northern San Joaquin  valleys.
