Be It Disparaging or Offensive - Speech is Speech and It Is Protected

A recent decision from the Ninth Circuit U.S. Court of Appeals offers a key reminder for public agencies: Even within a nonpublic forum, an individual’s and/or community’s Constitutionally protected freedom of speech cannot be infringed solely based upon the disparaging or offensive nature of the speech.

The appellate court held that when King County, in north-central Washington state, refused to display an advertisement related to global terrorism on public buses, it violated the First Amendment — even though the County determined the ad contained disparaging content and might disrupt the transit system.

In its opinion, the court of appeals held that the County’s bus advertising program was, for First Amendment purposes, a nonpublic (or limited public) forum where the government generally has more leeway to restrict speech, provided that regulations are reasonable and viewpoint neutral.

Ad Deemed Disparaging and Rejected

The provider of public transportation throughout Seattle’s metropolitan area, King County pays, in part, for its operation, by accepting ads for public display. The County will, however, refuse ads containing banned content, such as false statements, disparaging material or material that could disrupt the transit system.

In 2013, the U.S. Department of State submitted an ad concerning global terrorism to King County’s transit agency, King County Metro. The ad, depicting the photographs and names of 16 alleged terrorists, was entitled “Faces of Global Terrorism” and included information on how to report to authorities. Metro approved the ad and it ran on the County’s buses for nearly three weeks in June 2013 with little fanfare.

Eventually, the ad drew the attention of area residents, community leaders and a member of Congress, some of who wrote the ads were “incendiary” and “inflammatory” and would lead to an increase in hate crimes. While Metro reevaluated the ad’s approval, the State Department voluntarily retracted it.

Soon after, the American Freedom Defense Initiative submitted a near-identical ad fashioned after the pulled State Department advertisement. The County rejected the ad, concluding it contained three forms of prohibited content. AFDI corrected the ad’s factual inaccuracies and resubmitted it. The ad was again rejected, this time on two grounds: disparagement and its potential to disrupt the transit system.

Metro’s transit advertising policy defines disparaging and demeaning advertisements as those which a reasonably prudent person would believe “contains material that ridicules or mocks, is abusive or hostile to, or debases the dignity or stature of any individual, group of individuals or entity.”

This policy is at the heart of the 5-year-old case.

After the revised ad’s rejection, AFDI sued alleging the County violated AFDI’s freedom of speech. The lower court granted summary judgment in favor of the County. That decision was appealed.

Regulations Held to Unlawfully Discriminate on the Basis of Viewpoint

The Ninth Circuit held that, while the County could lawfully prohibit ads containing false statements, its ban on disparaging content unlawfully discriminated against specific viewpoints expressed through speech. The Court also held the County’s prohibition of disruptive content, while valid on its face, was arbitrarily applied to AFDI’s ad.

“The County permissibly rejected the factually inaccurate ad because the First Amendment does not require the County to display patently false content in a nonpublic forum,” Judge Susan P. Garber wrote in the opinion. “But the County’s rejection of the revised ad does not withstand scrutiny … we hold that the County’s disparagement standard discriminates …  on the basis of viewpoint.”

Applying the standard established in the 2017 U.S. Supreme Court case Matal v. Tam, the Ninth Circuit held that a government entity cannot prohibit speech simply because it is offensive. The court clarified that offensive speech, is, itself, a viewpoint and that the “government engages in viewpoint discrimination when it suppresses speech on the ground that the speech offends.”

Metro emphasized its disparagement clause is applied equally to all proposed ads — noting, regardless of content, none may give offense — but the court held the fact no one may express a particular viewpoint, in this case giving offense, did not change the viewpoint-discriminatory nature of the regulation.

When examining the County’s defense that the ad could cause a transit-system disruption, the court found its policy to be reasonable and viewpoint neutral, but that it was unreasonably applied to AFDI’s ad. The court rejected the County’s argument that the ad could perpetuate harmful stereotypes and upset riders — thereby causing a decrease in ridership, because it only portrayed persons of a certain race as terrorists.

Since Metro experienced no disruptions during the State Department ad’s three-week run on city buses, the Court concluded such harm from AFDI’s ad was not reasonably foreseeable.

The court reversed the lower court ruling, holding that neither of the County’s reasons for rejecting the revised ad withstood First Amendment scrutiny. Summary judgment was awarded to AFDI.

The takeaway for public agencies: Speech, even in a limited-public forum, where an agency would generally have more control, cannot be barred simply because it’s found to be offensive or disparaging.

In light of this decision, public agencies should review their advertising policies to ensure that they do not prohibit content based on the viewpoint that is expressed. While public agencies may still prohibit entire categories of speech, such as political ads, or ads depicting acts of violence, they cannot prohibit an advertisement just because it expresses a certain viewpoint regarding otherwise-permitted content.

EDCOE’s Coleen Johnson Receives Statewide Award

Coleen Johnson, Executive Director of Personnel Services at the El Dorado County Office of Education (EDCOE), was recently honored with the California County Superintendents Educational Services Association (CCSESA) – Personnel Administrative Services Steering Committee (PASSCo) ‘Star Award.’ The annual Star Award acknowledges one member from each Steering Committee for their contributions toward county offices of education, leadership within their committee, and service to CCSESA and the students of California. “I am humbled to receive this award and am honored to work with my colleagues at EDCOE, our districts, and across the region and state,” Coleen stated. “I am passionate about empowering those who benefit students, and I feel fortunate to serve in my role. This is an exciting time to be serving in a County Office of Education’s HR role, as we get to work as an integral part of a system of support to our County programs and our districts. It is an amazing opportunity to inspire, impact, and lead.”

The Tahoe Engineering Unit of the County of El Dorado Community Development Services, Department of Transportation invites you to attend a public meeting for the Evaluating Alternatives Phase of the San Bernardino Class 1 Bike Path Project (Project).  The Tahoe Engineering Unit has gathered and analyzed existing conditions information and developed and compared alternatives for the Project.  The results of this study have been combined into a Draft Feasibility Report. The purpose of this meeting is to present this information for public comment.  Following this meeting, the analysis will be further refined.

The public meeting will begin with a brief informational presentation followed by a question and answer period.  Attendees will have an opportunity to share opinions and concerns regarding the Project (orally and/or in writing).

Camino School Modernized Thanks to Measure H

The Camino Union School District was transformed after School Bond Measure H provided funding for a massive renovation project that took place this summer. In 2016, the community overwhelmingly supported the $4 million bond with 71% of the vote and provided the resources needed to enhance the campus which was built in 1952. 

As you walk onto campus, the first thing you notice is the bus yard was leveled and moved for contractors to expand the school’s main parking and drop off areas. The parking lot and drop off locations are divided by a fence with a designated crossing zone to streamline traffic and increase safety. Kindergarten parents now make use of their new drop-off area and gates close to the classrooms. On the lower, middle school campus, the bus yard is nestled next to the mechanic’s shop and includes a canopy to cover buses as they are washed.

Elevated exterior lighting and guardrails now outline the outside corridors. Student and staff bathrooms were completely redone, and new waterlines now separate irrigation from domestic lines to decrease the risk of contamination and regulate pressure. Water shut off valves and new septic lines, also provide safeguards. Two stormwater capture ponds were created to divert runoff into Webber Creek. Camino Polytechnic Charter School science classes are partnering with Ag in the Classroom and the County Water Agency to incorporate watershed studies into their lessons complete with research from the project engineers and tools such as rain gauges. 

The project provided revitalized grass areas, landscaping, and tree shrubs to beautify the campus. A wonderful outdoor lunch area was created with new picnic tables and cement tree boxes. Superintendent/Principal, Matt Smith, explained, “It was important that the renovations mirrored our beautiful area and the school’s history was retained. For example, local rock can be seen in the landscaping, and the original stone walls from the main buildings remained intact. The original flagpole was dedicated by the Native Sons of the Gold West, so their placard and time capsule were kept.”

Trauma-informed schools, a conversation with Jim Sporleder

It was a moment during a presentation about toxic stress and how it impacts a child’s ability to learn that upended a foundational belief about education held by Jim Sporleder, the former principal of Lincoln High School in Walla Walla, Washington. His leadership in changing his school’s culture to a trauma-informed school was captured in the widely-acclaimed documentary Paper Tigers.

“The most striking thing I heard was that when kids were highly escalated in the lower part of their brain, they physiologically can’t learn or take in new knowledge and problem-solve,” Sporleder recounted to participants in “Trauma-informed Schools: A conversation with Jim Sporleder”, an ACEs Connection webinar held on Nov. 19, 2018. Sporleder was describing how toxic stress from adverse childhood experiences (ACEs), such as living with an alcoholic parent or experiencing physical, emotional or sexual abuse, can put the brain in a state of fight, flight or freeze.  “That really blew up my 28-year philosophy that all kids can learn. I always believed that behavior was a choice. It was always being able to  help kids get over the hump and be responsible for their actions versus excusing it,” he told participants.

More than 800 people in education, pediatrics, nursing, social service, psychology and other sectors from across the country and around the globe — including Toronto, Glasgow, and Cape Town — had registered for the webinar to watch it live or recorded. And participants and ACEs in Education community members asked Sporleder a flurry of questions, including the nuts and bolts of training staff in trauma-informed practices, preventing teacher burnout, how to respond to a disruptive student, and how you get buy-in for trauma-informed practices from skeptics.  

“That day for me was a complete realization that my discipline wasn’t teaching, it was still punishing. That was what drove the transformation in me,” explained Sporleder who was a 28-year veteran in the Walla Walla School District and retired as principal from Lincoln High School in 2014. Once he had his personal mind-shift there was no turning back. In the first year of introducing changes to their approach, the school’s suspension rate dropped a whopping 85 percent. (See this ACEs Connection article for an in-depth look at the school’s transformation.)  And he told webinar participants that he was lucky: When he came back from that momentous talk on childhood trauma, which was given by Dr. John Medina, author of Brain Rules, he announced to his staff that they were changing how they approached discipline, and got little pushback.

What did that change look like on the ground? “You would see me moving away from reacting to the behavior and telling the student what the consequence was,” he said. Instead the focus became: “I began asking students what was going on and they would respond.” And just that small shift, he says, from reacting to asking them what happened opened up a new window.

“Kids were starting to tell me what was going on in their lives and in my head, was thinking ‘How the heck did they make it to school today!’” he explained. “Before, I missed that entire opportunity.”

Sporleder began leading the change at Lincoln in 2010, at a time when the idea of many trauma-informed practices such as mindfulness meditation were just beginning to take hold in some schools, he explained. Sporleder told webinar participants that Natalie Turner, a trainer from the CLEAR program (Collaborative Learning for Educational Achievement and Resilience) at Washington State University in Spokane,  helped guide staff through three concepts on which to focus. Those areas included teachers taking a deep look inward: How were they being triggered by students’ behaviors and how did that impact the students when they were triggered?

“And then we learned that the first step was we had to drop our personal mirror; the behavior wasn’t about us,” he said. The next area they learned was knowing that a kid who was triggered needed time to calm down from the grip of a triggered stress response.

With time for decompressing, explained Sporleder to the webinar participants, he and Lincoln staff could figure out what was going on behind the behavior, which led to building stronger relationships between students and teachers.

“We learned from the research that it only took one caring adult to have an impact on a student’s life path,” he said.

The National Weather Service in Sacramento has issued a Freeze Warning, which is in effect from 3 AM to 9 AM PST Monday.

* TEMPERATURE...Coldest lows ranging from 27 to 32. Local hard freeze conditions possible in low spots with temperatures in the mid 20s.

* IMPACTS...Freezing temperatures can damage or kill plants that are sensitive to cold. Please check on the elderly and make sure your animals have a warm shelter.

PRECAUTIONARY/PREPAREDNESS ACTIONS...

A Freeze Warning means sub-freezing temperatures are imminent or highly likely. These conditions will kill crops and other sensitive vegetation.

Question: What is the difference between a frost and a hard freeze? ... A hard freeze is a period of at least four consecutive hours of air temperatures that are below 25 degrees F. Many plants can survive a brief frost, but very few can survive a hard freeze.

Death Investigation - 13 year old student

On November 28, 2018, EDSO was called to Guiding Hands School on Windplay Drive in El Dorado Hills. A student at the school became violent and needed to be restrained by school staff, to prevent the injury of staff and students. While restraining the student, he became unresponsive. A teacher began CPR until medical aid arrived. The student was transported to Mercy Folsom in critical condition and later to UC Davis. On November 30, 2018, EDSO was informed that the student had passed away.

The 13 year old student was reported to EDSO as being 6 feet tall and 280 pounds, suffering from severe autism.

EDSO Deputies and Detectives interviewed the parties involved and are completing a full investigation.  At this time, there appears to be no evidence of foul play or criminal intent.

Frank A. Rush, Jr. Sworn in as New City Manager for South Lake

South Lake Tahoe, CA- The City of South Lake Tahoe is thrilled to welcome Frank A. Rush, Jr. as its new City Manager today.

Rush comes to South Lake Tahoe from Emerald Isle, NC, where he was the town manager for the past 17+ years.

“I am excited to join the team at the City of South Lake Tahoe, and look forward to working with the City Council, City employees, and the community to move South Lake Tahoe forward in the coming years,” said Rush., “It’s a truly exceptional place, and we will all be working hard to enhance the already high quality of life for our residents, visitors, and businesses.”

Rush has 25 years of local government experience in North Carolina and is known for his commitment to public service, public communications efforts, emphasis on customer service, creative and prudent financial management, and successful quality of life initiatives. During his time in North Carolina, he saw Emerald Isle through a period of sustained growth, completion of numerous capital initiatives, and its evolution as a premier oceanfront resort community. He also faced a number of challenges, including the great recession, Hurricanes Ophelia and Irene, and Hurricane Florence just a few months ago.

“I am excited for new opportunities and new challenges in South Lake Tahoe, and I am anxious to get started,” Rush said.

Rush will oversee an organization with almost 200 employees and an annual General Fund budget of more than $40 million. He received a Bachelor of Arts Degree in Environmental Studies from the State University of New York at Binghamton, and a Master of Public Administration degree from North Carolina State University.

Coming from Emerald Isle, with similar community dynamics, he’s uniquely suited to handle the challenges here in South Lake Tahoe. He says his priorities here are clear.

“I will be working hard to advance the City Council’s priorities, with an emphasis on public communications and responsive customer service. I will be seeking to build productive relationships with the community, promote a strong and vibrant local economy, and build trust in the City government,” Rush said.

City Council approved his contract earlier this year. Rush comes to South Lake Tahoe with his wife of 20 years, Suzanne, and two children – Jacob and Matthew. They are all excited to join the South Lake Tahoe community.

Tahoe Teenager killed in car crash near Cal Poly was a Cuesta College freshman

The San Luis Obispo County Sheriff’s Office has identified the teenager killed in a car crash near Cal Poly on Monday as 18-year-old Zachary Andrew Harris of South Lake Tahoe.

According to a Sheriff’s Office news release, Harris was the sole occupant of the vehicle that was traveling southbound on Highway 1 when it veered off the roadway and hit a tree near Stenner Creek Road.

He was declared dead at the scene.

According to the release, there is an ongoing and joint investigation between the San Luis Obispo County Coroner and the California Highway Patrol into the crash. 

Harris was a first semester student at Cuesta College, the community college confirmed Thursday.

In a letter sent to students and staff, Assistant Superintendent and Vice President of Student Services Mark Sanchez said on-campus counseling services and grief support are available for students through the Student Health Center.

“We offer our deepest condolences to Zachary’s family, friends and those who knew him during this difficult time,” he wrote.

El Dorado County Peer Council in Placerville Invites New Student Volunteers

(Placerville, CA) - The El Dorado County Peer Council in Placerville is currently inviting new student volunteers to participate in the program. Students in grades 8 to 12 who attend public or private schools in El Dorado County can take an active role in the local juvenile justice system through the youth Peer Council program. Peer Council is a collaborative program of the Probation Department and the Health and Human Services Agency (HHSA) of El Dorado County. 

Through the Peer Council, trained youth meet as a team twice per month on Mondays in Placerville with youth who have engaged in low level delinquent activity. The Peer Council makes recommendations about services and efforts that can assist each youthful offender in making positive changes. Peer Council members receive leadership training, guidance and support from staff in the departments of Probation and HHSA.  

Students interested in participating in the Peer Council program in Placerville are asked to please sign up and apply online by January 4, 2019, at https://sites.google.com/edcgov.us/peercouncil-pv/. Students accepted into the program will be notified regarding next steps and training. Once training is completed, students may serve as peer reviewers on the Council.  

"Peer Council is an innovative and engaging program for local youth," said Stephanie Carlson, volunteer coordinator with the Peer Council. "The goals of this early intervention program are to empower youthful offenders to positively change their lives by recognizing the importance of making good choices and addressing harmful behaviors, in a collaborative, positive and peer-supported environment. The program also encourages local youth leadership."

Placerville Rotary present a $100,000 check to Rotary Club of Paradise

Placerville Rotary President Kurt Raffetto along with Ron Thompson and Gordon Vicini traveled to Chico TODAY to present a $100,000 check to Rotary Club of Paradise. Accepting the check on their behalf was the president of the Paradise Club, Brian Grey!

The spaghetti feed fundraiser was just 12 days ago! Our community stepped up and dug deep to provide what is needed the most in Paradise.

The funds were given today directly to the Paradise Rotary Club so that they could direct, managed and provide support at a local level.

Thank you to all who have given donations, volunteered and shared good thoughts to our neighbors to the north. Paradise is going to need much more than this, but we hope this will bring some smiles to an area that needs them, especially this holiday season.
